55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the persons who are eligible for appointment as a
88 temporary justice of the peace.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 27.055(c), Government Code, is amended
1111 to read as follows:
1212 (c) In Subsections (b) and (f), "qualified person" means a
1313 person who:
1414 (1) has served [as a justice of the peace] for not less
1515 than 4 1/2 years as a:
1616 (A) justice of the peace;
1717 (B) judge of a:
1818 (i) municipal court;
1919 (ii) constitutional county court;
2020 (iii) statutory county court; or
2121 (iv) district court; or
2222 (C) justice of an appellate court; and
2323 (2) [who] has not been convicted of a criminal offense
2424 that involves moral turpitude.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2015.
