99 relating to the use of school district buildings as polling place
1010 locations.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 37, Education Code, is
1313 amended by adding Section 37.111 to read as follows:
1414 Sec. 37.111. SECURITY GUIDELINES ESTABLISHED FOR POLLING
1515 PLACES LOCATED ON SCHOOL DISTRICT PROPERTY. (a) The board of
1616 trustees of a school district shall develop security guidelines for
1717 school district property selected for use as a polling place under
1818 Section 43.031, Election Code.
1919 (b) In developing guidelines under this section, the board
2020 of trustees shall consult with:
2121 (1) the local law enforcement agency with jurisdiction
2222 over the school district property selected as a polling place,
2323 regarding reasonable security accommodations that may be made to
2424 the property; and
2525 (2) the election administrator, regarding any polling
2626 place requirements that may affect the security guidelines.
2727 (c) Subsection (b)(1) may not be interpreted to require the
2828 board of trustees to obtain or contract for the presence of law
2929 enforcement or security personnel for the purpose of securing a
3030 polling place located on school district property.
3131 (d) Not later than 48 hours before the first day of voting
3232 held at the polling place:
3333 (1) the board of trustees must provide security
3434 guidelines to the local law enforcement agency with jurisdiction
3535 over the school district property selected as a polling place; and
3636 (2) the board of trustees and the election
3737 administrator must jointly or separately file an affidavit with the
3838 secretary of state confirming security guidelines for the polling
3939 place have been developed.
4040 (e) Failure to comply with this section does not affect the
4141 requirement of the board of trustees to make a school facility
4242 available for use as a polling place under Section 43.031, Election
4343 Code.
4444 (f) The secretary of state shall prescribe the form of the
4545 affidavit required by this section and adopt rules for the
4646 administration of this section.
4747 SECTION 2. This Act takes effect September 1, 2015.
