11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter D, Chapter 37, Education Code, is |
---|
13 | 13 | | amended by adding Section 37.111 to read as follows: |
---|
14 | 14 | | Sec. 37.111. SECURITY GUIDELINES ESTABLISHED FOR POLLING |
---|
15 | 15 | | PLACES LOCATED ON SCHOOL DISTRICT PROPERTY. (a) The board of |
---|
16 | 16 | | trustees of a school district shall develop security guidelines for |
---|
17 | 17 | | school district property selected for use as a polling place under |
---|
18 | 18 | | Section 43.031, Election Code. |
---|
19 | 19 | | (b) In developing guidelines under this section, the board |
---|
20 | 20 | | of trustees shall consult with: |
---|
21 | 21 | | (1) the local law enforcement agency with jurisdiction |
---|
22 | 22 | | over the school district property selected as a polling place, |
---|
23 | 23 | | regarding reasonable security accommodations that may be made to |
---|
24 | 24 | | the property; and |
---|
25 | 25 | | (2) the election administrator, regarding any polling |
---|
26 | 26 | | place requirements that may affect the security guidelines. |
---|
27 | 27 | | (c) Subsection (b)(1) may not be interpreted to require the |
---|
28 | 28 | | board of trustees to obtain or contract for the presence of law |
---|
29 | 29 | | enforcement or security personnel for the purpose of securing a |
---|
30 | 30 | | polling place located on school district property. |
---|
31 | 31 | | (d) Not later than 48 hours before the first day of voting |
---|
32 | 32 | | held at the polling place: |
---|
33 | 33 | | (1) the board of trustees must provide security |
---|
34 | 34 | | guidelines to the local law enforcement agency with jurisdiction |
---|
35 | 35 | | over the school district property selected as a polling place; and |
---|
36 | 36 | | (2) the board of trustees and the election |
---|
37 | 37 | | administrator must jointly or separately file an affidavit with the |
---|
38 | 38 | | secretary of state confirming security guidelines for the polling |
---|
39 | 39 | | place have been developed. |
---|
40 | 40 | | (e) Failure to comply with this section does not affect the |
---|
41 | 41 | | requirement of the board of trustees to make a school facility |
---|
42 | 42 | | available for use as a polling place under Section 43.031, Election |
---|
43 | 43 | | Code. |
---|
44 | 44 | | (f) The secretary of state shall prescribe the form of the |
---|
45 | 45 | | affidavit required by this section and adopt rules for the |
---|
46 | 46 | | administration of this section. |
---|
47 | 47 | | SECTION 2. This Act takes effect September 1, 2015. |
