55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the final decision in a contested case regarding
88 occupational licensing before a State Office of Administrative
99 Hearings administrative law judge.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2001.058, Government Code, is amended by
1212 adding Subsection (g) to read as follows:
1313 (g) Notwithstanding Subsection (e) or any other law, in a
1414 contested case before a state agency that concerns licensing in
1515 relation to an occupational license and is not disposed of by
1616 stipulation, agreed settlement, or consent order, an occupational
1717 license holder may elect to have the administrative law judge
1818 render the final decision in the contested case. If the license
1919 holder elects to have the administrative law judge render the final
2020 decision, the provisions applicable to a contested case under
2121 Subsection (f) apply to a contested case described by this
2222 subsection.
2323 SECTION 2. The change in law made by this Act applies only
2424 to a contested case filed on or after the effective date of this
2525 Act. A contested case filed before the effective date of this Act
2626 is governed by the law in effect on the date the contested case was
2727 filed, and that law is continued in effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2015.
