10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 2001.058, Government Code, is amended by | |
12 | 12 | adding Subsection (g) to read as follows: | |
13 | 13 | (g) Notwithstanding Subsection (e) or any other law, in a | |
14 | 14 | contested case before a state agency that concerns licensing in | |
15 | 15 | relation to an occupational license and is not disposed of by | |
16 | 16 | stipulation, agreed settlement, or consent order, an occupational | |
17 | 17 | license holder may elect to have the administrative law judge | |
18 | 18 | render the final decision in the contested case. If the license | |
19 | 19 | holder elects to have the administrative law judge render the final | |
20 | 20 | decision, the provisions applicable to a contested case under | |
21 | 21 | Subsection (f) apply to a contested case described by this | |
22 | 22 | subsection. | |
23 | 23 | SECTION 2. The change in law made by this Act applies only | |
24 | 24 | to a contested case filed on or after the effective date of this | |
25 | 25 | Act. A contested case filed before the effective date of this Act | |
26 | 26 | is governed by the law in effect on the date the contested case was | |
27 | 27 | filed, and that law is continued in effect for that purpose. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2015. |
