88 AN ACT
99 relating to the prosecution and punishment of the use of
1010 benzodiazepines or gamma butyrolactone to facilitate the
1111 commission of the offense of aggravated sexual assault and the
1212 addition of gamma butyrolactone to Penalty Group 1 of the Texas
1313 Controlled Substances Act for purposes of criminal prosecution;
1414 amending provisions subject to a criminal penalty.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 22.021(a), Penal Code, is amended to
1717 read as follows:
1818 (a) A person commits an offense:
1919 (1) if the person:
2020 (A) intentionally or knowingly:
2121 (i) causes the penetration of the anus or
2222 sexual organ of another person by any means, without that person's
2323 consent;
2424 (ii) causes the penetration of the mouth of
2525 another person by the sexual organ of the actor, without that
2626 person's consent; or
2727 (iii) causes the sexual organ of another
2828 person, without that person's consent, to contact or penetrate the
2929 mouth, anus, or sexual organ of another person, including the
3030 actor; or
3131 (B) intentionally or knowingly:
3232 (i) causes the penetration of the anus or
3333 sexual organ of a child by any means;
3434 (ii) causes the penetration of the mouth of
3535 a child by the sexual organ of the actor;
3636 (iii) causes the sexual organ of a child to
3737 contact or penetrate the mouth, anus, or sexual organ of another
3838 person, including the actor;
3939 (iv) causes the anus of a child to contact
4040 the mouth, anus, or sexual organ of another person, including the
4141 actor; or
4242 (v) causes the mouth of a child to contact
4343 the anus or sexual organ of another person, including the actor; and
4444 (2) if:
4545 (A) the person:
4646 (i) causes serious bodily injury or
4747 attempts to cause the death of the victim or another person in the
4848 course of the same criminal episode;
4949 (ii) by acts or words places the victim in
5050 fear that any person will become the victim of an offense under
5151 Section 20A.02(a)(3), (4), (7), or (8) or that death, serious
5252 bodily injury, or kidnapping will be imminently inflicted on any
5353 person;
5454 (iii) by acts or words occurring in the
5555 presence of the victim threatens to cause any person to become the
5656 victim of an offense under Section 20A.02(a)(3), (4), (7), or (8) or
5757 to cause the death, serious bodily injury, or kidnapping of any
5858 person;
5959 (iv) uses or exhibits a deadly weapon in the
6060 course of the same criminal episode;
6161 (v) acts in concert with another who
6262 engages in conduct described by Subdivision (1) directed toward the
6363 same victim and occurring during the course of the same criminal
6464 episode; or
6565 (vi) administers or provides a
6666 benzodiazepine, flunitrazepam, otherwise known as rohypnol, gamma
6767 butyrolactone, gamma hydroxybutyrate, or ketamine to the victim of
6868 the offense with the intent of facilitating the commission of the
6969 offense;
7070 (B) the victim is younger than 14 years of age; or
7171 (C) the victim is an elderly individual or a
7272 disabled individual.
7373 SECTION 2. Section 22.021(b), Penal Code, is amended by
7474 adding Subdivision (3) to read as follows:
7575 (3) "Benzodiazepine" means any drug included in the
7676 class of drugs of the same name, that:
7777 (A) produce a depressant effect on the central
7878 nervous system; and
7979 (B) are characterized by a benzene ring fused to
8080 a seven-member diazepine ring.
8181 SECTION 3. Section 481.102, Health and Safety Code, is
8282 amended to read as follows:
8383 Sec. 481.102. PENALTY GROUP 1. Penalty Group 1 consists of:
8484 (1) the following opiates, including their isomers,
8585 esters, ethers, salts, and salts of isomers, esters, and ethers,
8686 unless specifically excepted, if the existence of these isomers,
8787 esters, ethers, and salts is possible within the specific chemical
8888 designation:
8989 Alfentanil;
9090 Allylprodine;
9191 Alphacetylmethadol;
9292 Benzethidine;
9393 Betaprodine;
9494 Clonitazene;

259259 SECTION 4. The change in law made by this Act applies only
260260 to an offense committed on or after the effective date of this Act.
261261 An offense committed before the effective date of this Act is
262262 governed by the law in effect on the date the offense was committed,
263263 and the former law is continued in effect for that purpose. For
264264 purposes of this section, an offense was committed before the
265265 effective date of this Act if any element of the offense occurred
266266 before that date.
267267 SECTION 5. This Act takes effect September 1, 2015.
