11 | 11 | | commission of the offense of aggravated sexual assault and the |
---|
12 | 12 | | addition of gamma butyrolactone to Penalty Group 1 of the Texas |
---|
13 | 13 | | Controlled Substances Act for purposes of criminal prosecution; |
---|
14 | 14 | | amending provisions subject to a criminal penalty. |
---|
15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
16 | 16 | | SECTION 1. Section 22.021(a), Penal Code, is amended to |
---|
17 | 17 | | read as follows: |
---|
18 | 18 | | (a) A person commits an offense: |
---|
19 | 19 | | (1) if the person: |
---|
20 | 20 | | (A) intentionally or knowingly: |
---|
21 | 21 | | (i) causes the penetration of the anus or |
---|
22 | 22 | | sexual organ of another person by any means, without that person's |
---|
23 | 23 | | consent; |
---|
24 | 24 | | (ii) causes the penetration of the mouth of |
---|
25 | 25 | | another person by the sexual organ of the actor, without that |
---|
26 | 26 | | person's consent; or |
---|
27 | 27 | | (iii) causes the sexual organ of another |
---|
28 | 28 | | person, without that person's consent, to contact or penetrate the |
---|
29 | 29 | | mouth, anus, or sexual organ of another person, including the |
---|
30 | 30 | | actor; or |
---|
31 | 31 | | (B) intentionally or knowingly: |
---|
32 | 32 | | (i) causes the penetration of the anus or |
---|
33 | 33 | | sexual organ of a child by any means; |
---|
34 | 34 | | (ii) causes the penetration of the mouth of |
---|
35 | 35 | | a child by the sexual organ of the actor; |
---|
36 | 36 | | (iii) causes the sexual organ of a child to |
---|
37 | 37 | | contact or penetrate the mouth, anus, or sexual organ of another |
---|
38 | 38 | | person, including the actor; |
---|
39 | 39 | | (iv) causes the anus of a child to contact |
---|
40 | 40 | | the mouth, anus, or sexual organ of another person, including the |
---|
41 | 41 | | actor; or |
---|
42 | 42 | | (v) causes the mouth of a child to contact |
---|
43 | 43 | | the anus or sexual organ of another person, including the actor; and |
---|
44 | 44 | | (2) if: |
---|
45 | 45 | | (A) the person: |
---|
46 | 46 | | (i) causes serious bodily injury or |
---|
47 | 47 | | attempts to cause the death of the victim or another person in the |
---|
48 | 48 | | course of the same criminal episode; |
---|
49 | 49 | | (ii) by acts or words places the victim in |
---|
50 | 50 | | fear that any person will become the victim of an offense under |
---|
51 | 51 | | Section 20A.02(a)(3), (4), (7), or (8) or that death, serious |
---|
52 | 52 | | bodily injury, or kidnapping will be imminently inflicted on any |
---|
53 | 53 | | person; |
---|
54 | 54 | | (iii) by acts or words occurring in the |
---|
55 | 55 | | presence of the victim threatens to cause any person to become the |
---|
56 | 56 | | victim of an offense under Section 20A.02(a)(3), (4), (7), or (8) or |
---|
57 | 57 | | to cause the death, serious bodily injury, or kidnapping of any |
---|
58 | 58 | | person; |
---|
59 | 59 | | (iv) uses or exhibits a deadly weapon in the |
---|
60 | 60 | | course of the same criminal episode; |
---|
61 | 61 | | (v) acts in concert with another who |
---|
62 | 62 | | engages in conduct described by Subdivision (1) directed toward the |
---|
63 | 63 | | same victim and occurring during the course of the same criminal |
---|
64 | 64 | | episode; or |
---|
65 | 65 | | (vi) administers or provides a |
---|
66 | 66 | | benzodiazepine, flunitrazepam, otherwise known as rohypnol, gamma |
---|
67 | 67 | | butyrolactone, gamma hydroxybutyrate, or ketamine to the victim of |
---|
68 | 68 | | the offense with the intent of facilitating the commission of the |
---|
69 | 69 | | offense; |
---|
70 | 70 | | (B) the victim is younger than 14 years of age; or |
---|
71 | 71 | | (C) the victim is an elderly individual or a |
---|
72 | 72 | | disabled individual. |
---|
73 | 73 | | SECTION 2. Section 22.021(b), Penal Code, is amended by |
---|
74 | 74 | | adding Subdivision (3) to read as follows: |
---|
75 | 75 | | (3) "Benzodiazepine" means any drug included in the |
---|
76 | 76 | | class of drugs of the same name, that: |
---|
77 | 77 | | (A) produce a depressant effect on the central |
---|
78 | 78 | | nervous system; and |
---|
79 | 79 | | (B) are characterized by a benzene ring fused to |
---|
80 | 80 | | a seven-member diazepine ring. |

81 | 81 | | SECTION 3. Section 481.102, Health and Safety Code, is |

82 | 82 | | amended to read as follows: |
