55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the determination of the appraised value of property
88 for purposes of an ad valorem tax protest or appeal.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 41.43, Tax Code, is amended by adding
1111 Subsection (e) to read as follows:
1212 (e) For purposes of Subsection (b)(3), the median appraised
1313 value of comparable properties must be calculated using the
1414 appraised value of each comparable property as shown in the
1515 appraisal records submitted to the appraisal review board by the
1616 chief appraiser under Section 25.22 or 25.23.
1717 SECTION 2. Section 42.26, Tax Code, is amended by adding
1818 Subsection (e) to read as follows:
1919 (e) For purposes of Subsection (a)(3), the median appraised
2020 value of comparable properties must be calculated using the
2121 appraised value of each comparable property as shown in the
2222 appraisal records certified by the chief appraiser under Section
2323 26.01.
2424 SECTION 3. Section 41.43(e), Tax Code, as added by this Act,
2525 applies only to a protest under Chapter 41, Tax Code, for which a
2626 notice of protest is filed on or after the effective date of this
2727 Act. A protest under Chapter 41, Tax Code, for which a notice of
2828 protest was filed before the effective date of this Act is governed
2929 by the law in effect on the date the notice of protest was filed, and
3030 the former law is continued in effect for that purpose.
3131 SECTION 4. Section 42.26(e), Tax Code, as added by this Act,
3232 applies only to an appeal under Chapter 42, Tax Code, for which a
3333 petition for review is filed on or after the effective date of this
3434 Act. An appeal under Chapter 42, Tax Code, for which a petition for
3535 review was filed before the effective date of this Act is governed
3636 by the law in effect on the date the petition for review was filed,
3737 and the former law is continued in effect for that purpose.
3838 SECTION 5. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2015.
