66 AN ACT
77 relating to studies on homeless veterans and youth.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 2306, Government Code, is amended by
1010 adding Subchapter OO to read as follows:
1111 SUBCHAPTER OO. HOMELESS VETERANS AND YOUTH
1212 Sec. 2306.1101. DEFINITIONS. In this subchapter:
1313 (1) "Homeless veteran" means a person who has served
1414 on active duty in the armed forces of the United States or in the
1515 state military forces as defined by Section 437.001 and who:
1616 (A) lacks a fixed, regular, and adequate
1717 nighttime residence, including a person who is:
1818 (i) temporarily allowed to stay in the
1919 house of another person due to loss of housing;
2020 (ii) temporarily living in a motel or
2121 hotel;
2222 (iii) living in an emergency shelter; or
2323 (iv) abandoned in a hospital;
2424 (B) has a primary nighttime residence that is a
2525 public or private place not designed or ordinarily used as a regular
2626 sleeping accommodation for humans; or
2727 (C) is living in a car, park, other public space,
2828 abandoned building, substandard housing, bus or train station, or
2929 similar setting.
3030 (2) "Homeless youth" means a person who is younger
3131 than 25 years of age, including a migratory child as defined by
3232 Section 1309, Elementary and Secondary Education Act of 1965 (20
3333 U.S.C. Section 6399), and who:
3434 (A) lacks a fixed, regular, and adequate
3535 nighttime residence, including a person who is:
3636 (i) temporarily allowed to stay in the
3737 house of another person due to loss of housing;
3838 (ii) temporarily living in a motel or
3939 hotel;
4040 (iii) living in an emergency shelter;
4141 (iv) abandoned in a hospital; or
4242 (v) awaiting foster care placement;
4343 (B) has a primary nighttime residence that is a
4444 public or private place not designed or ordinarily used as a regular
4545 sleeping accommodation for humans; or
4646 (C) is living in a car, park, other public space,
4747 abandoned building, substandard housing, bus or train station, or
4848 similar setting.
4949 Sec. 2306.1102. STUDY ON HOMELESS VETERANS. (a) The
5050 department, in conjunction with the Department of Family and
5151 Protective Services, the Texas Veterans Commission, the Texas
5252 Workforce Commission, and the Texas Homeless Education Office,
5353 shall conduct a study on homeless veterans.
5454 (b) In conducting the study, the department shall:
5555 (1) collect data on the number of homeless veterans in
5656 this state;
5757 (2) examine the needs of homeless veterans and the
5858 degree to which current programs are meeting those needs; and
5959 (3) identify any sources of funding that might be
6060 available to provide services to homeless veterans.
6161 (c) The department shall submit a report on the study to the
6262 legislature not later than December 1, 2016. The report must
6363 include a summary of the information resulting from the study and
6464 recommendations for changes in law necessary to provide services to
6565 or otherwise assist homeless veterans.
6666 Sec. 2306.1103. STUDY ON HOMELESS YOUTH. (a) The
6767 department, in conjunction with the Department of Family and
6868 Protective Services, the Texas Education Agency, and the Texas
6969 Homeless Education Office, shall conduct a study on homeless youth.
7070 (b) In conducting the study, the department shall:
7171 (1) collect data on the number of homeless youth in
7272 this state;
7373 (2) examine the needs of homeless youth and the degree
7474 to which current programs are meeting those needs; and
7575 (3) identify any sources of funding that might be
7676 available to provide services to homeless youth.
7777 (c) The department shall submit a report on the study to the
7878 legislature not later than December 1, 2016. The report must
7979 include a summary of the information resulting from the study and
8080 recommendations for changes in law necessary to provide services to
8181 or otherwise assist homeless youth.
8282 Sec. 2306.1104. EXPIRATION. This subchapter expires
8383 September 1, 2017.
8484 SECTION 2. This Act takes effect immediately if it receives
8585 a vote of two-thirds of all the members elected to each house, as
8686 provided by Section 39, Article III, Texas Constitution. If this
8787 Act does not receive the vote necessary for immediate effect, this
8888 Act takes effect September 1, 2015.
