77 ting to the prohibition of housing discrimination and to the
88 enforcement of that prohibition; creating an offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 301.003, Property Code, is amended by
1111 amending Subdivisions (1) and (6) and adding Subdivisions (1-a),
1212 (9-a), (9-b), and (10-a) to read as follows:
1313 (1) "Aggrieved person" includes any person who:
1414 (A) claims to have been injured by a
1515 discriminatory housing practice; or
1616 (B) believes that the person will be injured by a
1717 discriminatory housing practice that is about to occur.
1818 (6) "Disability" means a mental or physical impairment
1919 that substantially limits at least one major life activity, a
2020 record of the impairment, or being regarded as having the
2121 impairment. The term does not include current illegal use or
2222 addiction to any drug or illegal or federally controlled substance
2323 [and does not apply to an individual because of an individual's
2424 sexual orientation or because that individual is a transvestite].
2525 (9-a) "Military status" means a person who is serving
2626 or has served in the uniformed services, as defined by 20 C.F.R.
2727 Section 1002.5, and who, if discharged, was discharged or released
2828 under conditions other than dishonorable.
2929 (10-a) "Sexual orientation" means the actual or
3030 perceived status of a person with respect to the person's
3131 sexuality.
3232 SECTION 2. Section 301.021, Property Code, is amended by
3333 amending Subsections (a) and (b) and adding Subsection (b-1) to
3434 read as follows:
3535 (a) A person may not refuse to sell or rent, after the making
3636 of a bona fide offer, refuse to negotiate for the sale or rental of,
3737 or in any other manner make unavailable or deny a dwelling to
3838 another because of race, color, religion, sex, familial status,
3939 [or] national origin, military status, or sexual orientation.
4040 (b) A person may not discriminate against another in the
4141 terms, conditions, or privileges of sale or rental of a dwelling or
4242 in providing services or facilities in connection with a sale or
4343 rental of a dwelling because of race, color, religion, sex,
4444 familial status, [or] national origin, military status, or sexual
4545 orientation.
4646 SECTION 3. Section 301.022, Property Code, is amended to
4747 read as follows:
4848 Sec. 301.022. PUBLICATION. A person may not make, print, or
4949 publish or effect the making, printing, or publishing of a notice,
5050 statement, or advertisement that is about the sale or rental of a
5151 dwelling and that indicates any preference, limitation, or
5252 discrimination or the intention to make a preference, limitation,
5353 or discrimination because of race, color, religion, sex,
5454 disability, familial status, [or] national origin, military
5555 status, or sexual orientation.
5656 SECTION 4. Section 301.023, Property Code, is amended to
5757 read as follows:
5858 Sec. 301.023. INSPECTION. A person may not represent to
5959 another because of race, color, religion, sex, disability, familial
6060 status, [or] national origin, military status, or sexual
6161 orientation that a dwelling is not available for inspection for
6262 sale or rental when the dwelling is available for inspection.
6363 SECTION 5. Section 301.024, Property Code, is amended to
6464 read as follows:
6565 Sec. 301.024. ENTRY INTO NEIGHBORHOOD. A person may not,
6666 for profit, induce or attempt to induce another to sell or rent a
6767 dwelling by representations regarding the entry or prospective
6868 entry into a neighborhood of a person of a particular race, color,
6969 religion, sex, disability, familial status, [or] national origin,
7070 military status, or sexual orientation.
7171 SECTION 6. Section 301.026(a), Property Code, is amended to
7272 read as follows:
7373 (a) A person whose business includes engaging in
7474 residential real estate related transactions may not discriminate
7575 against another in making a real estate related transaction
7676 available or in the terms or conditions of a real estate related
7777 transaction because of race, color, religion, sex, disability,
7878 familial status, [or] national origin, military status, or sexual
7979 orientation.
8080 SECTION 7. Section 301.027, Property Code, is amended to
8181 read as follows:
8282 Sec. 301.027. BROKERAGE SERVICES. A person may not deny
8383 another access to, or membership or participation in, a
8484 multiple-listing service, real estate brokers' organization, or
8585 other service, organization, or facility relating to the business
8686 of selling or renting dwellings, or discriminate against a person
8787 in the terms or conditions of access, membership, or participation
8888 in such an organization, service, or facility because of race,
8989 color, religion, sex, disability, familial status, [or] national
9090 origin, military status, or sexual orientation.
9191 SECTION 8. Sections 301.042(a) and (c), Property Code, are
9292 amended to read as follows:
9393 (a) This chapter does not prohibit a religious
9494 organization, association, or society or a nonprofit institution or
9595 organization operated, supervised, or controlled by or in
9696 conjunction with a religious organization, association, or society
9797 from:
9898 (1) limiting the sale, rental, or occupancy of
9999 dwellings that it owns or operates for other than a commercial
100100 purpose to persons of the same religion; or
101101 (2) giving preference to persons of the same religion,
102102 unless membership in the religion is restricted because of race,
103103 color, sex, disability, familial status, [or] national origin,
104104 military status, or sexual orientation.
105105 (c) This chapter does not prohibit a person engaged in the
106106 business of furnishing appraisals of real property from considering
107107 in those appraisals factors other than race, color, religion, sex,
108108 disability, familial status, [or] national origin, military
109109 status, or sexual orientation.
110110 SECTION 9. Section 301.068, Property Code, is amended to
111111 read as follows:
112112 Sec. 301.068. REFERRAL TO MUNICIPALITY. (a) Subject to
113113 Subsections (b) and (c), the [The] commission may defer proceedings
114114 under this chapter and refer a complaint to a municipality that has
115115 been certified by the federal Department of Housing and Urban
116116 Development as a substantially equivalent fair housing agency.
117117 (b) The commission shall defer proceedings and refer a
118118 complaint to a municipality under Subsection (a) if:
119119 (1) the complaint alleges discrimination based on a
120120 characteristic other than race, color, religion, sex, disability,
121121 familial status, national origin, military status, or sexual
122122 orientation; and
123123 (2) the alleged discrimination occurred in a
124124 municipality that has laws prohibiting the alleged discrimination.
125125 (c) The commission may not defer proceedings and refer a
126126 complaint under Subsection (a) to a municipality in which the
127127 alleged discrimination occurred if that municipality does not have
128128 laws prohibiting the alleged discrimination.
129129 SECTION 10. Section 301.171(a), Property Code, is amended
130130 to read as follows:
131131 (a) A person commits an offense if the person, without
132132 regard to whether the person is acting under color of law, by force
133133 or threat of force intentionally intimidates or interferes with a
134134 person:
135135 (1) because of the person's race, color, religion,
136136 sex, disability, familial status, [or] national origin, military
137137 status, or sexual orientation, and because the person is or has been
138138 selling, purchasing, renting, financing, occupying, or contracting
139139 or negotiating for the sale, purchase, rental, financing, or
140140 occupation of any dwelling or applying for or participating in a
141141 service, organization, or facility relating to the business of
142142 selling or renting dwellings; or
143143 (2) because the person is or has been or to intimidate
144144 the person from:
145145 (A) participating, without discrimination
146146 because of race, color, religion, sex, disability, familial status,
147147 [or] national origin, military status, or sexual orientation, in an
148148 activity, service, organization, or facility described by
149149 Subdivision (1); [or]
150150 (B) affording another person opportunity or
151151 protection to so participate; or
152152 (C) lawfully aiding or encouraging other persons
153153 to participate, without discrimination because of race, color,
154154 religion, sex, disability, familial status, [or] national origin,
155155 military status, or sexual orientation, in an activity, service,
156156 organization, or facility described by Subdivision (1).
157157 SECTION 11. The change in law made by this Act applies only
158158 to a complaint filed with the Texas Workforce Commission civil
159159 rights division on or after the effective date of this Act. A
160160 complaint filed before that date is governed by the law as it
161161 existed immediately before the effective date of this Act, and that
162162 law is continued in effect for that purpose.
163163 SECTION 12. This Act takes effect September 1, 2015.
