| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 39, Education Code, is amended by adding |
|---|
| 10 | 10 | | Subchapter N to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER N. TEXAS COMMISSION ON NEXT GENERATION ASSESSMENTS AND |
|---|
| 12 | 12 | | ACCOUNTABILITY |
|---|
| 13 | 13 | | Sec. 39.501. DEFINITION. In this subchapter, "commission" |
|---|
| 14 | 14 | | means the Texas Commission on Next Generation Assessments and |
|---|
| 15 | 15 | | Accountability. |
|---|
| 16 | 16 | | Sec. 39.502. TEXAS COMMISSION ON NEXT GENERATION |
|---|
| 17 | 17 | | ASSESSMENTS AND ACCOUNTABILITY. (a) The Texas Commission on Next |
|---|
| 18 | 18 | | Generation Assessments and Accountability is established to |
|---|
| 19 | 19 | | develop and make recommendations for new systems of student |
|---|
| 20 | 20 | | assessment and public school accountability. |
|---|
| 21 | 21 | | (b) The commission is composed of: |
|---|
| 22 | 22 | | (1) seven members appointed by the governor; |
|---|
| 23 | 23 | | (2) four members appointed by the lieutenant governor; |
|---|
| 24 | 24 | | and |
|---|
| 25 | 25 | | (3) four members appointed by the speaker of the house |
|---|
| 26 | 26 | | of representatives. |
|---|
| 27 | 27 | | (c) In making appointments under this section, at least one |
|---|
| 28 | 28 | | person must be appointed to represent each of the following groups: |
|---|
| 29 | 29 | | (1) a parent or person standing in parental relation |
|---|
| 30 | 30 | | to a student enrolled in the public school system; |
|---|
| 31 | 31 | | (2) an educator in the public school system; |
|---|
| 32 | 32 | | (3) a member of the business community; |
|---|
| 33 | 33 | | (4) a member of the civic community; |
|---|
| 34 | 34 | | (5) a leader in student assessment development and |
|---|
| 35 | 35 | | use; and |
|---|
| 36 | 36 | | (6) a leader in research concerning student assessment |
|---|
| 37 | 37 | | and education outcomes. |
|---|
| 38 | 38 | | Sec. 39.503. PRESIDING OFFICER. The governor shall |
|---|
| 39 | 39 | | designate the presiding officer of the commission. |
|---|
| 40 | 40 | | Sec. 39.504. COMPENSATION AND REIMBURSEMENT. A member of |
|---|
| 41 | 41 | | the commission is not entitled to compensation for service on the |
|---|
| 42 | 42 | | commission but is entitled to reimbursement for actual and |
|---|
| 43 | 43 | | necessary expenses incurred in performing commission duties. |
|---|
| 44 | 44 | | Sec. 39.505. ADMINISTRATIVE SUPPORT AND FUNDING. (a) |
|---|
| 45 | 45 | | Staff members of the agency shall provide administrative support |
|---|
| 46 | 46 | | for the commission. |
|---|
| 47 | 47 | | (b) Funding for the administrative and operational expenses |
|---|
| 48 | 48 | | of the commission shall be provided by appropriation to the agency |
|---|
| 49 | 49 | | for that purpose. |
|---|
| 50 | 50 | | Sec. 39.506. RECOMMENDATIONS. The commission shall develop |
|---|
| 51 | 51 | | recommendations under this subchapter to address: |
|---|
| 52 | 52 | | (1) the purpose of a state accountability system and |
|---|
| 53 | 53 | | the role of student assessment in that system; |
|---|
| 54 | 54 | | (2) opportunities to assess students that: |
|---|
| 55 | 55 | | (A) provide actionable information for a parent |
|---|
| 56 | 56 | | or person standing in parental relation to a student, an educator, |
|---|
| 57 | 57 | | and the public; |
|---|
| 58 | 58 | | (B) support learning activities; |
|---|
| 59 | 59 | | (C) recognize application of skills and |
|---|
| 60 | 60 | | knowledge; |
|---|
| 61 | 61 | | (D) measure student educational growth toward |
|---|
| 62 | 62 | | mastery; and |
|---|
| 63 | 63 | | (E) value critical thinking; |
|---|
| 64 | 64 | | (3) alignment of state performance standards with |
|---|
| 65 | 65 | | college and career readiness requirements in collaboration with the |
|---|
| 66 | 66 | | Texas Workforce Commission and Texas Higher Education Coordinating |
|---|
| 67 | 67 | | Board; and |
|---|
| 68 | 68 | | (4) policy changes necessary to enable a student to |
|---|
| 69 | 69 | | progress through subject matter and grade levels on demonstration |
|---|
| 70 | 70 | | of mastery. |
|---|
| 71 | 71 | | Sec. 39.507. REPORT. The commission shall prepare and |
|---|
| 72 | 72 | | deliver a report to the governor and the legislature that |
|---|
| 73 | 73 | | recommends statutory changes to improve systems of student |
|---|
| 74 | 74 | | assessment and public school accountability not later than December |
|---|
| 75 | 75 | | 1, 2016. |
|---|
| 76 | 76 | | Sec. 39.508. PUBLIC MEETINGS AND PUBLIC INFORMATION. (a) |
|---|
| 77 | 77 | | The commission may hold public meetings as needed to fulfill its |
|---|
| 78 | 78 | | duties under this subchapter. |
|---|
| 79 | 79 | | (b) The commission is subject to Chapters 551 and 552, |
|---|
| 80 | 80 | | Government Code. |
|---|
| 81 | 81 | | Sec. 39.509. COMMISSION ABOLISHED; EXPIRATION OF |
|---|
| 82 | 82 | | SUBCHAPTER. (a) The commission is abolished January 1, 2017. |
|---|
| 83 | 83 | | (b) This subchapter expires January 1, 2017. |
|---|
| 84 | 84 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 85 | 85 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 86 | 86 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 87 | 87 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 88 | 88 | | Act takes effect September 1, 2015. |
