| 7 | 7 | | relating to erecting certain signs on private property before an |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 391.005, Transportation Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 391.005. EXEMPTION. This chapter does not apply to a |
|---|
| 13 | 13 | | sign erected solely for and relating to a public election if the |
|---|
| 14 | 14 | | sign: |
|---|
| 15 | 15 | | (1) is on private property; |
|---|
| 16 | 16 | | (2) is erected not earlier than the 90th day before: |
|---|
| 17 | 17 | | (A) the date of the election; or |
|---|
| 18 | 18 | | (B) the first day of the early voting period for |
|---|
| 19 | 19 | | an election with early voting; |
|---|
| 20 | 20 | | (2-a) [and] is removed not later than the 10th day |
|---|
| 21 | 21 | | after the election date; |
|---|
| 22 | 22 | | (3) is constructed of lightweight material; and |
|---|
| 23 | 23 | | (4) has a surface area not larger than 50 square feet. |

| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to an offense committed on or after the effective date of this Act. |
|---|
| 26 | 26 | | An offense committed before the effective date of this Act is |
|---|
| 27 | 27 | | governed by the law in effect on the date the offense was committed, |
|---|
| 28 | 28 | | and the former law is continued in effect for that purpose. For |
|---|
| 29 | 29 | | purposes of this section, an offense was committed before the |
|---|
| 30 | 30 | | effective date of this Act if any element of the offense was |
|---|
| 31 | 31 | | committed before that date. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2015. |
