 A BILL TO BE ENTITLED
 AN ACT
 relating to approval by the commissioner of education of an
 expansion or new school amendment for a charter holder previously
 denied a charter by the State Board of Education.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 12.114, Education Code, is amended by
 adding Subsection (d) to read as follows:
 (d)  The commissioner may not approve a request for an
 expansion or new school amendment submitted by a charter holder
 under Subsection (c) if the State Board of Education has previously
 voted against the grant of a new charter as provided by Section
 12.101(b-0) for an identical or substantially similar campus
 submitted by the charter holder or an affiliate of the charter
 holder.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2015.
