| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 12.114, Education Code, is amended by | |
| 12 | 12 | adding Subsection (d) to read as follows: | |
| 13 | 13 | (d) The commissioner may not approve a request for an | |
| 14 | 14 | expansion or new school amendment submitted by a charter holder | |
| 15 | 15 | under Subsection (c) if the State Board of Education has previously | |
| 16 | 16 | voted against the grant of a new charter as provided by Section | |
| 17 | 17 | 12.101(b-0) for an identical or substantially similar campus | |
| 18 | 18 | submitted by the charter holder or an affiliate of the charter | |
| 19 | 19 | holder. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2015. |
