| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter D, Chapter 8843, Special District |
|---|
| 10 | 10 | | Local Laws Code, is amended by adding Section 8843.1516 to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | Sec. 8843.1516. PRODUCTION FEE. The district by rule may |
|---|
| 13 | 13 | | charge and collect a production fee not to exceed 10 cents for each |
|---|
| 14 | 14 | | thousand gallons of groundwater permitted from a non-exempt |
|---|
| 15 | 15 | | commercial well in the district. |
|---|
| 16 | 16 | | SECTION 2. Section 8843.153, Special District Local Laws |
|---|
| 17 | 17 | | Code, is amended to read as follows: |
|---|
| 18 | 18 | | Sec. 8843.153. TAXES AND OTHER FEES PROHIBITED. |
|---|
| 19 | 19 | | Notwithstanding Section 8843.101 or Subchapter G, Chapter 36, Water |
|---|
| 20 | 20 | | Code, the district may not: |
|---|
| 21 | 21 | | (1) impose a tax; or |
|---|
| 22 | 22 | | (2) assess or collect any fees except as authorized by |
|---|
| 23 | 23 | | this subchapter [Section 8843.151 or 8843.152]. |
|---|
| 24 | 24 | | SECTION 3. Section 8843.1516, Special District Local Laws |
|---|
| 25 | 25 | | Code, as added by this Act, applies only to groundwater produced on |
|---|
| 26 | 26 | | or after the effective date of this Act. |
|---|
| 27 | 27 | | SECTION 4. This Act takes effect September 1, 2015. |
