55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain fees paid by political subdivisions in
88 connection with the ordering or performance of an autopsy.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 49.10, Code of Criminal Procedure, is
1111 amended by amending Subsections (b), (g), and (h) and adding
1212 Subsections (b-1), (g-1), and (h-1) to read as follows:
1313 (b) For a body or body part found outside the boundaries of a
1414 municipality, the [The] commissioners court of the county shall pay
1515 a reasonable fee for a consultation obtained by a justice of the
1616 peace under Subsection (a) of this article.
1717 (b-1) For a body or body part found within the boundaries of
1818 a municipality, the municipality shall pay a reasonable fee for a
1919 consultation obtained by a justice of the peace under Subsection
2020 (a) of this article.
2121 (g) For a body or body part found outside the boundaries of a
2222 municipality, the [The] commissioners court shall pay a reasonable
2323 fee to a physician performing an autopsy on the order of a justice
2424 of the peace, if a fee is assessed.
2525 (g-1) For a body or body part found within the boundaries of
2626 a municipality, the municipality shall pay a reasonable fee to a
2727 physician performing an autopsy on the order of a justice of the
2828 peace, if a fee is assessed.
2929 (h) For a body or body part found outside the boundaries of a
3030 municipality, the [The] commissioners court shall pay a reasonable
3131 fee for the transportation of the [a] body or body part to a place
3232 where an autopsy can be performed under this article if a justice of
3333 the peace orders the body or body part to be transported to the
3434 place.
3535 (h-1) For a body or body part found within the boundaries of
3636 a municipality, the municipality shall pay a reasonable fee for the
3737 transportation of the body or body part to a place where an autopsy
3838 can be performed under this article if a justice of the peace orders
3939 the body or body part to be transported to the place.
4040 SECTION 2. The change in law made by this Act applies only
4141 to an autopsy ordered on or after the effective date of this Act. An
4242 autopsy ordered before the effective date of this Act is governed by
4343 the law in effect on the date the autopsy was ordered, and the
4444 former law is continued in effect for that purpose.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2015.
