6	6	AN ACT
7	7	relating to certain fees paid by political subdivisions in
8	8	connection with the ordering or performance of an autopsy.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Article 49.10, Code of Criminal Procedure, is
11	11	amended by amending Subsections (b), (g), and (h) and adding
12	12	Subsections (b-1), (g-1), and (h-1) to read as follows:
13	13	(b) For a body or body part found outside the boundaries of a
14	14	municipality, the [The] commissioners court of the county shall pay
15	15	a reasonable fee for a consultation obtained by a justice of the
16	16	peace under Subsection (a) of this article.
17	17	(b-1) For a body or body part found within the boundaries of
18	18	a municipality, the municipality shall pay a reasonable fee for a
19	19	consultation obtained by a justice of the peace under Subsection
20	20	(a) of this article.
21	21	(g) For a body or body part found outside the boundaries of a
22	22	municipality, the [The] commissioners court shall pay a reasonable
23	23	fee to a physician performing an autopsy on the order of a justice
24	24	of the peace, if a fee is assessed.
25	25	(g-1) For a body or body part found within the boundaries of
26	26	a municipality, the municipality shall pay a reasonable fee to a
27	27	physician performing an autopsy on the order of a justice of the
28	28	peace, if a fee is assessed.
29	29	(h) For a body or body part found outside the boundaries of a
30	30	municipality, the [The] commissioners court shall pay a reasonable
31	31	fee for the transportation of the [a] body or body part to a place
32	32	where an autopsy can be performed under this article if a justice of
33	33	the peace orders the body or body part to be transported to the
34	34	place.
35	35	(h-1) For a body or body part found within the boundaries of
36	36	a municipality, the municipality shall pay a reasonable fee for the
37	37	transportation of the body or body part to a place where an autopsy
38	38	can be performed under this article if a justice of the peace orders
39	39	the body or body part to be transported to the place.
40	40	SECTION 2. The change in law made by this Act applies only
41	41	to an autopsy ordered on or after the effective date of this Act. An
42	42	autopsy ordered before the effective date of this Act is governed by
43	43	the law in effect on the date the autopsy was ordered, and the
44	44	former law is continued in effect for that purpose.
45	45	SECTION 3. This Act takes effect immediately if it receives
46	46	a vote of two-thirds of all the members elected to each house, as
47	47	provided by Section 39, Article III, Texas Constitution. If this
48	48	Act does not receive the vote necessary for immediate effect, this
49	49	Act takes effect September 1, 2015.
