55 AN ACT
66 relating to the authority of a municipality to adopt requirements
77 for the installation of fire protection sprinkler systems.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sec. 1301.3565(f), Occupations Code, is amended
1010 as follows:
1111 (f) A plumbing inspector who meets the requirements of the
1212 board may inspect a multipurpose residential fire protection
1313 sprinkler installation. A certified fire inspector for a political
1414 subdivision or state may inspect or review plans for the sprinkler
1515 portion only of a multipurpose residential fire protection
1616 sprinkler installation, repair or replacement.
1717 SECTION 2. Section 1301.551(i), Occupations Code, is
1818 amended as follows:
1919 (i) Notwithstanding any other provision of state law,
2020 [after January 1, 2009,] a municipality may [not] enact an
2121 ordinance, bylaw, order, building code, or rule requiring the
2222 installation of a multipurpose residential fire protection
2323 sprinkler system or any other fire sprinkler protection system in a
2424 new [or existing] one- or two-family dwelling. [A municipality may
2525 adopt an ordinance, bylaw, order, or rule allowing a multipurpose
2626 residential fire protection sprinkler specialist or other
2727 contractor to offer, for a fee, the installation of a fire sprinkler
2828 protection system in a new one- or two-family dwelling.]
2929 SECTION 3. This Act takes effect September 1, 2015.
