7 | 7 | | for the installation of fire protection sprinkler systems. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Sec. 1301.3565(f), Occupations Code, is amended |
---|
10 | 10 | | as follows: |
---|
11 | 11 | | (f) A plumbing inspector who meets the requirements of the |
---|
12 | 12 | | board may inspect a multipurpose residential fire protection |
---|
13 | 13 | | sprinkler installation. A certified fire inspector for a political |
---|
14 | 14 | | subdivision or state may inspect or review plans for the sprinkler |
---|
15 | 15 | | portion only of a multipurpose residential fire protection |
---|
16 | 16 | | sprinkler installation, repair or replacement. |
---|
17 | 17 | | SECTION 2. Section 1301.551(i), Occupations Code, is |
---|
18 | 18 | | amended as follows: |
---|
19 | 19 | | (i) Notwithstanding any other provision of state law, |
---|
20 | 20 | | [after January 1, 2009,] a municipality may [not] enact an |
---|
21 | 21 | | ordinance, bylaw, order, building code, or rule requiring the |
---|
22 | 22 | | installation of a multipurpose residential fire protection |
---|
23 | 23 | | sprinkler system or any other fire sprinkler protection system in a |
---|
24 | 24 | | new [or existing] one- or two-family dwelling. [A municipality may |
---|
25 | 25 | | adopt an ordinance, bylaw, order, or rule allowing a multipurpose |
---|
26 | 26 | | residential fire protection sprinkler specialist or other |
---|
27 | 27 | | contractor to offer, for a fee, the installation of a fire sprinkler |
---|
28 | 28 | | protection system in a new one- or two-family dwelling.] |
---|
29 | 29 | | SECTION 3. This Act takes effect September 1, 2015. |
