A BILL TO BE ENTITLED
AN ACT
relating to the awarding of attorney's fees in election contest
lawsuits.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 231.002, Election Code, is amended to
read as follows:
(a) Sec. 231.002. APPLICABILITY OF RULES GOVERNING CIVIL
SUITS. Except as otherwise provided by this subtitle, the rules
governing civil suits in the district court apply to an election
contest in the district court, specifically the awarding of
attorney's fees and costs of suit as per the governing rules of
civil suits in district court.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
