| 9 | 9 | SECTION 1. Section 231.002, Election Code, is amended to | |
| 10 | 10 | read as follows: | |
| 11 | 11 | (a) Sec. 231.002. APPLICABILITY OF RULES GOVERNING CIVIL | |
| 12 | 12 | SUITS. Except as otherwise provided by this subtitle, the rules | |
| 13 | 13 | governing civil suits in the district court apply to an election | |
| 14 | 14 | contest in the district court, specifically the awarding of | |
| 15 | 15 | attorney's fees and costs of suit as per the governing rules of | |
| 16 | 16 | civil suits in district court. | |
| 17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
| 18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
| 19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
| 20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
| 21 | 21 | Act takes effect September 1, 2015. |
