| 6 | 6 | | relating to the requirement of a franchised dealer's license for |

| 7 | 7 | | the sale of certain truck cranes. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 2301.002, Occupations Code, is amended |
|---|
| 10 | 10 | | by adding Subdivisions (33) and (33-a) to read as follows: |
|---|
| 11 | 11 | | (33) "Truck crane" means a truck chassis mounted with |
|---|
| 12 | 12 | | a self-propelled boom that raises, shifts, or lowers heavy weights. |
|---|
| 13 | 13 | | (33-a) "Truck crane manufacturer" means a person other |
|---|
| 14 | 14 | | than the manufacturer of a motor vehicle chassis who, before the |
|---|
| 15 | 15 | | retail sale of the motor vehicle, performs modifications on the |
|---|
| 16 | 16 | | chassis that result in the finished product being classified as a |
|---|
| 17 | 17 | | truck crane. |

| 18 | 18 | | SECTION 2. Section 2301.252, Occupations Code, is amended |
|---|
| 19 | 19 | | by amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 20 | 20 | | follows: |
|---|
| 21 | 21 | | (a) Except as provided by Subsection (c), a [A |
|---|
| 22 | 22 | | ] person may |
|---|
| 23 | 23 | | not engage in the business of buying, selling, or exchanging new |
|---|
| 24 | 24 | | motor vehicles unless the person: |
|---|
| 25 | 25 | | (1) holds a franchised dealer's license issued under |
|---|
| 26 | 26 | | this chapter for the make of new motor vehicle being bought, sold, |
|---|
| 27 | 27 | | or exchanged; or |
|---|
| 28 | 28 | | (2) is a bona fide employee of the holder of a |
|---|
| 29 | 29 | | franchised dealer's license. |
|---|
| 30 | 30 | | (c) Subsection (a) does not apply to a motor vehicle that is |
|---|
| 31 | 31 | | a truck crane produced by a truck crane manufacturer in this state. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2015. |
