44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a pilot project for complaints filed with certain state
77 boards or agencies.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 154, Occupations Code, is
1010 amended by adding Section 154.059 to read as follows:
1111 Sec. 154.059. DISMISSAL OF CERTAIN COMPLAINTS. (a)
1212 Notwithstanding any other law, the board shall dismiss, with
1313 prejudice for want of prosecution, a complaint filed with the board
1414 against a license holder if:
1515 (1) the complaint is pending with the board and has not
1616 been referred to the State Office of Administrative Hearings;
1717 (2) the license holder files a motion to dismiss the
1818 complaint with the board; and
1919 (3) the complaint was filed with the board more than 12
2020 months before the date the motion to dismiss the complaint was
2121 filed.
2222 (b) Not later than December 31, 2016, the board shall submit
2323 a report to the governor, lieutenant governor, and speaker of the
2424 house of representatives that contains:
2525 (1) the number and types of complaints dismissed under
2626 this section; and
2727 (2) the amount of time each complaint was pending with
2828 the board before the complaint was dismissed.
2929 (c) This subsection and Subsection (a) expire August 31,
3030 2016.
3131 (d) This subsection and Subsection (b) expire January 1,
3232 2017.
3333 SECTION 2. Subchapter F, Chapter 1001, Occupations Code, is
3434 amended by adding Section 1001.256 to read as follows:
3535 Sec. 1001.256. DISMISSAL OF CERTAIN COMPLAINTS. (a)
3636 Notwithstanding any other law, the board shall dismiss, with
3737 prejudice for want of prosecution, a complaint filed with the board
3838 against a license holder if:
3939 (1) the complaint is pending with the board and has not
4040 been referred to the State Office of Administrative Hearings;
4141 (2) the license holder files a motion to dismiss the
4242 complaint with the board; and
4343 (3) the complaint was filed with the board more than 12
4444 months before the date the motion to dismiss the complaint was
4545 filed.
4646 (b) Not later than December 31, 2016, the board shall submit
4747 a report to the governor, lieutenant governor, and speaker of the
4848 house of representatives that contains:
4949 (1) the number and types of complaints dismissed under
5050 this section; and
5151 (2) the amount of time each complaint was pending with
5252 the board before the complaint was dismissed.
5353 (c) This subsection and Subsection (a) expire August 31,
5454 2016.
5555 (d) This subsection and Subsection (b) expire January 1,
5656 2017.
5757 SECTION 3. The changes in law made by this Act apply to a
5858 complaint filed with a state agency that is pending on the effective
5959 date of this Act.
6060 SECTION 4. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2015.
