| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 22, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 22.012 to read as follows: |
|---|
| 12 | 12 | | Sec. 22.012. COMPENSATION FOR ADDITIONAL WORKDAY. (a) Not |
|---|
| 13 | 13 | | later than May 1 of each year, a school district shall publish an |
|---|
| 14 | 14 | | official calendar for the following school year that specifies each |
|---|
| 15 | 15 | | day that is an official workday for school district employees. |
|---|
| 16 | 16 | | (b) If a school district employee is required to work on |
|---|
| 17 | 17 | | additional days that are not identified as workdays on the calendar |
|---|
| 18 | 18 | | published as required by Subsection (a), the district shall |
|---|
| 19 | 19 | | compensate the employee for the additional days. |
|---|
| 20 | 20 | | (c) A school district must compensate an employee for each |
|---|
| 21 | 21 | | additional day of work in an amount not less than the greater of: |
|---|
| 22 | 22 | | (1) the amount that the school district would deduct |
|---|
| 23 | 23 | | from the employee's annual salary if the employee accrued an |
|---|
| 24 | 24 | | absence beyond the employee's available personal leave; |
|---|
| 25 | 25 | | (2) a daily rate, calculated by dividing the |
|---|
| 26 | 26 | | employee's annual salary by the number of workdays specified in the |
|---|
| 27 | 27 | | calendar required under Subsection (a); or |
|---|
| 28 | 28 | | (3) the same rate by which the annual salary of the |
|---|
| 29 | 29 | | employee may be reduced as provided by Section 21.4021(b). |
|---|
| 30 | 30 | | (d) A school district may not take any action that results |
|---|
| 31 | 31 | | in a longer workday for a school district employee to comply with |
|---|
| 32 | 32 | | this section. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2015. |
