66 relating to the governance independent school districts.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 11.059, Education Code, is amended to
99 read as follows:
1010 Sec. 11.059. TERMS. (a) A trustee of an independent school
1111 district serves a term of three or four years.
1212 (b) Elections for trustees with three-year terms shall be
1313 held annually. The terms of one-third of the trustees, or as near to
1414 one-third as possible, expire each year.
1515 (c) Elections for trustees with four-year terms shall be
1616 held biennially. The terms of one-half of the trustees, or as near
1717 to one-half as possible, expire every two years.
1818 (d) A board policy must state the schedule on which specific
1919 terms expire.
2020 (e) [Not later than December 31, 2011, t]The board of
2121 trustees may adopt a resolution changing the length of the terms of
2222 its trustees. The resolution must provide for staggered terms of
2323 either three or four years and specify the manner in which the
2424 transition from the length of the former term to the modified term
2525 is made. The transition must begin with the first regular election
2626 for trustees that occurs at least 180 days after [January 1, 2012]
2727 adopting the resolution, and a trustee who serves on that date shall
2828 serve the remainder of that term. [This subsection expires January
2929 1, 2017.]
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2015.
