| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 11.059, Education Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | Sec. 11.059. TERMS. (a) A trustee of an independent school |
|---|
| 11 | 11 | | district serves a term of three or four years. |
|---|
| 12 | 12 | | (b) Elections for trustees with three-year terms shall be |
|---|
| 13 | 13 | | held annually. The terms of one-third of the trustees, or as near to |
|---|
| 14 | 14 | | one-third as possible, expire each year. |
|---|
| 15 | 15 | | (c) Elections for trustees with four-year terms shall be |
|---|
| 16 | 16 | | held biennially. The terms of one-half of the trustees, or as near |
|---|
| 17 | 17 | | to one-half as possible, expire every two years. |
|---|
| 18 | 18 | | (d) A board policy must state the schedule on which specific |
|---|
| 19 | 19 | | terms expire. |
|---|
| 20 | 20 | | (e) [Not later than December 31, 2011, t]The board of |
|---|
| 21 | 21 | | trustees may adopt a resolution changing the length of the terms of |
|---|
| 22 | 22 | | its trustees. The resolution must provide for staggered terms of |
|---|
| 23 | 23 | | either three or four years and specify the manner in which the |
|---|
| 24 | 24 | | transition from the length of the former term to the modified term |
|---|
| 25 | 25 | | is made. The transition must begin with the first regular election |
|---|
| 26 | 26 | | for trustees that occurs at least 180 days after [January 1, 2012] |
|---|
| 27 | 27 | | adopting the resolution, and a trustee who serves on that date shall |
|---|
| 28 | 28 | | serve the remainder of that term. [This subsection expires January |
|---|
| 29 | 29 | | 1, 2017.] |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2015. |
