| 7 | 7 | | relating to the amount of unclaimed lottery prize money to be |
|---|
| 8 | 8 | | deposited in the fund for veterans' assistance. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 466.408(b), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) If a claim is not made for prize money on or before the |
|---|
| 13 | 13 | | 180th day after the date on which the winner was selected, the prize |
|---|
| 14 | 14 | | money shall be used in the following order of priority: |
|---|
| 15 | 15 | | (1) subject to legislative appropriation, not more |
|---|
| 16 | 16 | | than $20 million in prize money each year may be deposited to the |
|---|
| 17 | 17 | | Department of State Health Services state-owned multicategorical |
|---|
| 18 | 18 | | teaching hospital account, which is an account in the general |
|---|
| 19 | 19 | | revenue fund, or appropriated from that account to provide indigent |
|---|
| 20 | 20 | | health care services as specified in Chapter 61, Health and Safety |
|---|
| 21 | 21 | | Code; |
|---|
| 22 | 22 | | (2) not more than $5 million in prize money each year |
|---|
| 23 | 23 | | may be appropriated to the Health and Human Services Commission and |
|---|
| 24 | 24 | | shall be used to support the provision of inpatient hospital |
|---|
| 25 | 25 | | services in hospitals located in the 15 counties that comprise the |
|---|
| 26 | 26 | | Texas-Mexico border area, with payment for those services to be not |
|---|
| 27 | 27 | | less than the amount established under the Tax Equity and Fiscal |
|---|
| 28 | 28 | | Responsibility Act of 1982 (TEFRA) cost reimbursement methodology |
|---|
| 29 | 29 | | for the hospital providing the services; |
|---|
| 30 | 30 | | (3) in each state fiscal year, [the remaining amount, |
|---|
| 31 | 31 | | not to exceed] $5 million in prize money [in each state fiscal year |
|---|
| 32 | 32 | | less any amount deposited in the fund in that year attributable to |
|---|
| 33 | 33 | | the lottery game operated under Section 466.027,] shall be |
|---|
| 34 | 34 | | deposited to the fund for veterans' assistance; and |
|---|
| 35 | 35 | | (4) all prize money subject to this section and not |
|---|
| 36 | 36 | | deposited or appropriated in accordance with Subdivision (1), (2), |
|---|
| 37 | 37 | | or (3) shall be deposited to the credit of the foundation school |
|---|
| 38 | 38 | | fund. |
|---|
| 39 | 39 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 40 | 40 | | 466.408(b), Government Code, applies only to a prize for which the |
|---|
| 41 | 41 | | winner is selected on or after the effective date of this Act. A |
|---|
| 42 | 42 | | prize for which the winner was selected before that date is governed |
|---|
| 43 | 43 | | by the law as it existed immediately before the effective date of |
|---|
| 44 | 44 | | this Act, and that law is continued in effect for that purpose. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2015. |
