| 11 | 5 | | relating to oaths and affirmations of certain judges of municipal |

| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 29.005, Government Code, is amended to |
|---|
| 15 | 9 | | read as follows: |
|---|
| 16 | 10 | | Sec. 29.005. TERM OF OFFICE. (a) The judge of a municipal |
|---|
| 17 | 11 | | court serves for a term of office of two years unless the |
|---|
| 18 | 12 | | municipality provides for a longer term pursuant to Section 11, |
|---|
| 19 | 13 | | Article XI, [Section 11, of the] Texas Constitution. |
|---|
| 20 | 14 | | (b) A municipal court judge who is not reappointed by the |
|---|
| 21 | 15 | | 91st day following the expiration of a term of office shall, absent |
|---|
| 22 | 16 | | action by the appointing authority, continue to serve for another |
|---|
| 23 | 17 | | term of office beginning on the date the previous term of office |
|---|
| 24 | 18 | | expired. |
|---|
| 25 | 19 | | (c) A judge of a municipal court who continues to serve for |
|---|
| 26 | 20 | | another term of office under Subsection (b) may continue to perform |
|---|
| 27 | 21 | | the duties of the office without taking an additional oath or |
|---|
| 28 | 22 | | affirmation required under Section 1, Article XVI, Texas |
|---|
| 29 | 23 | | Constitution. |
|---|
| 30 | 24 | | SECTION 2. The changes in law made by this Act apply to a |
|---|
| 31 | 25 | | judge of a municipal court who serves in the office before, on, or |
|---|
| 32 | 26 | | after the effective date of this Act. |

| 33 | 27 | | SECTION 3. This Act takes effect September 1, 2015. |
