114 relating to the creation of the Fort Bend County Municipal Utility
125 District No. 218; granting a limited power of eminent domain;
136 providing authority to issue bonds; providing authority to impose
147 assessments, fees, and taxes.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1710 Code, is amended by adding Chapter 7927 to read as follows:
1811 CHAPTER 7927. FORT BEND COUNTY MUNICIPAL UTILITY DISTRICT NO. 218
1912 SUBCHAPTER A. GENERAL PROVISIONS
2013 Sec. 7927.001. DEFINITIONS. In this chapter:
2114 (1) "Board" means the district's board of directors.
2215 (2) "Commission" means the Texas Commission on
2316 Environmental Quality.
2417 (3) "Director" means a board member.
2518 (4) "District" means the Fort Bend County Municipal
2619 Utility District No. 218.
2720 Sec. 7927.002. NATURE OF DISTRICT. The district is a
2821 municipal utility district created under Section 59, Article XVI,
2922 Texas Constitution.
3023 Sec. 7927.003. CONFIRMATION AND DIRECTORS' ELECTION
3124 REQUIRED. The temporary directors shall hold an election to
3225 confirm the creation of the district and to elect five permanent
3326 directors as provided by Section 49.102, Water Code.
3427 Sec. 7927.004. CONSENT OF MUNICIPALITY REQUIRED. The
3528 temporary directors may not hold an election under Section 7927.003
3629 until each municipality in whose corporate limits or
3730 extraterritorial jurisdiction the district is located has
3831 consented by ordinance or resolution to the creation of the
3932 district and to the inclusion of land in the district.
4033 Sec. 7927.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4134 The district is created to serve a public purpose and benefit.
4235 (b) The district is created to accomplish the purposes of:
4336 (1) a municipal utility district as provided by
4437 general law and Section 59, Article XVI, Texas Constitution; and
4538 (2) Section 52, Article III, Texas Constitution, that
4639 relate to the construction, acquisition, improvement, operation,
4740 or maintenance of macadamized, graveled, or paved roads, or
4841 improvements, including storm drainage, in aid of those roads.
4942 Sec. 7927.006. INITIAL DISTRICT TERRITORY. (a) The
5043 district is initially composed of the territory described by
5144 Section 2 of the Act enacting this chapter.
5245 (b) The boundaries and field notes contained in Section 2 of
5346 the Act enacting this chapter form a closure. A mistake made in the
5447 field notes or in copying the field notes in the legislative process
5548 does not affect the district's:
5649 (1) organization, existence, or validity;
5750 (2) right to issue any type of bond for the purposes
5851 for which the district is created or to pay the principal of and
5952 interest on a bond;
6053 (3) right to impose a tax; or
6154 (4) legality or operation.
6255 SUBCHAPTER B. BOARD OF DIRECTORS
6356 Sec. 7927.051. GOVERNING BODY; TERMS. (a) The district is
6457 governed by a board of five elected directors.
6558 (b) Except as provided by Section 7927.052, directors serve
6659 staggered four-year terms.
6760 Sec. 7927.052. TEMPORARY DIRECTORS. (a) On or after
6861 September 1, 2015, the owner or owners of a majority of the assessed
6962 value of the real property in the district may submit a petition to
7063 the commission requesting that the commission appoint as temporary
7164 directors the five persons named in the petition. The commission
7265 shall appoint as temporary directors the five persons named in the
7366 petition.
7467 (b) Temporary directors serve until the earlier of:
7568 (1) the date permanent directors are elected under
7669 Section 7927.003; or
7770 (2) September 1, 2019.
7871 (c) If permanent directors have not been elected under
7972 Section 7927.003 and the terms of the temporary directors have
8073 expired, successor temporary directors shall be appointed or
8174 reappointed as provided by Subsection (d) to serve terms that
8275 expire on the earlier of:
8376 (1) the date permanent directors are elected under
8477 Section 7927.003; or
8578 (2) the fourth anniversary of the date of the
8679 appointment or reappointment.
8780 (d) If Subsection (c) applies, the owner or owners of a
8881 majority of the assessed value of the real property in the district
8982 may submit a petition to the commission requesting that the
9083 commission appoint as successor temporary directors the five
9184 persons named in the petition. The commission shall appoint as
9285 successor temporary directors the five persons named in the
9386 petition.
9487 SUBCHAPTER C. POWERS AND DUTIES
9588 Sec. 7927.101. GENERAL POWERS AND DUTIES. The district has
9689 the powers and duties necessary to accomplish the purposes for
9790 which the district is created.
9891 Sec. 7927.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9992 DUTIES. The district has the powers and duties provided by the
10093 general law of this state, including Chapters 49 and 54, Water Code,
10194 applicable to municipal utility districts created under Section 59,
10295 Article XVI, Texas Constitution.
10396 Sec. 7927.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10497 52, Article III, Texas Constitution, the district may design,
10598 acquire, construct, finance, issue bonds for, improve, operate,
10699 maintain, and convey to this state, a county, or a municipality for
107100 operation and maintenance macadamized, graveled, or paved roads, or
108101 improvements, including storm drainage, in aid of those roads.
109102 Sec. 7927.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
110103 project must meet all applicable construction standards, zoning and
111104 subdivision requirements, and regulations of each municipality in
112105 whose corporate limits or extraterritorial jurisdiction the road
113106 project is located.
114107 (b) If a road project is not located in the corporate limits
115108 or extraterritorial jurisdiction of a municipality, the road
116109 project must meet all applicable construction standards,
117110 subdivision requirements, and regulations of each county in which
118111 the road project is located.
119112 (c) If the state will maintain and operate the road, the
120113 Texas Transportation Commission must approve the plans and
121114 specifications of the road project.
122115 Sec. 7927.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
123116 OR RESOLUTION. The district shall comply with all applicable
124117 requirements of any ordinance or resolution that is adopted under
125118 Section 54.016 or 54.0165, Water Code, and that consents to the
126119 creation of the district or to the inclusion of land in the
127120 district.
128121 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
129122 Sec. 7927.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
130123 district may issue, without an election, bonds and other
131124 obligations secured by:
132125 (1) revenue other than ad valorem taxes; or
133126 (2) contract payments described by Section 7927.153.
134127 (b) The district must hold an election in the manner
135128 provided by Chapters 49 and 54, Water Code, to obtain voter approval
136129 before the district may impose an ad valorem tax or issue bonds
137130 payable from ad valorem taxes.
138131 (c) The district may not issue bonds payable from ad valorem
139132 taxes to finance a road project unless the issuance is approved by a
140133 vote of a two-thirds majority of the district voters voting at an
141134 election held for that purpose.
142135 Sec. 7927.152. OPERATION AND MAINTENANCE TAX. (a) If
143136 authorized at an election held under Section 7927.151, the district
144137 may impose an operation and maintenance tax on taxable property in
145138 the district in accordance with Section 49.107, Water Code.
146139 (b) The board shall determine the tax rate. The rate may not
147140 exceed the rate approved at the election.
148141 Sec. 7927.153. CONTRACT TAXES. (a) In accordance with
149142 Section 49.108, Water Code, the district may impose a tax other than
150143 an operation and maintenance tax and use the revenue derived from
151144 the tax to make payments under a contract after the provisions of
152145 the contract have been approved by a majority of the district voters
153146 voting at an election held for that purpose.
154147 (b) A contract approved by the district voters may contain a
155148 provision stating that the contract may be modified or amended by
156149 the board without further voter approval.
157150 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
158151 Sec. 7927.201. AUTHORITY TO ISSUE BONDS AND OTHER
159152 OBLIGATIONS. The district may issue bonds or other obligations
160153 payable wholly or partly from ad valorem taxes, impact fees,
161154 revenue, contract payments, grants, or other district money, or any
162155 combination of those sources, to pay for any authorized district
163156 purpose.
164157 Sec. 7927.202. TAXES FOR BONDS. At the time the district
165158 issues bonds payable wholly or partly from ad valorem taxes, the
166159 board shall provide for the annual imposition of a continuing
167160 direct ad valorem tax, without limit as to rate or amount, while all
168161 or part of the bonds are outstanding as required and in the manner
169162 provided by Sections 54.601 and 54.602, Water Code.
170163 Sec. 7927.203. BONDS FOR ROAD PROJECTS. At the time of
171164 issuance, the total principal amount of bonds or other obligations
172165 issued or incurred to finance road projects and payable from ad
173166 valorem taxes may not exceed one-fourth of the assessed value of the
174167 real property in the district.
175168 SECTION 2. The Fort Bend County Municipal Utility District
176169 No. 218 initially includes all the territory contained in the
177170 following area:
178171 A 232.215 acre, or 10,115,268 square feet more or less tract of
179172 land, being all of that 250 acre tract of land conveyed to Frank
180173 Chalupa and described in a deed recorded in Volume 182, Page 194 of
181174 the Deed Records of Fort Bend County, Texas, subsequently divided
182175 into seven parcels and conveyed as follows: 41.58 acres conveyed to
183176 Edwin G. Chalupa et al in a deed recorded in Volume 708, Page 5,
184177 corrected in document recorded in Volume 753, Page 746, Deed
185178 Records of Fort Bend County, Texas, subsequently conveyed to
186179 Patrick B. Chalupa, Melissa K. Chalupa aka Melissa Chalupa Gonzalez
187180 by deeds recorded in Document Numbers 9621563, 2007000110,

403396 SECTION 3. (a) The legal notice of the intention to
404397 introduce this Act, setting forth the general substance of this
405398 Act, has been published as provided by law, and the notice and a
406399 copy of this Act have been furnished to all persons, agencies,
407400 officials, or entities to which they are required to be furnished
408401 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
409402 Government Code.
410403 (b) The governor, one of the required recipients, has
411404 submitted the notice and Act to the Texas Commission on
412405 Environmental Quality.
413406 (c) The Texas Commission on Environmental Quality has filed
414407 its recommendations relating to this Act with the governor, the
415408 lieutenant governor, and the speaker of the house of
416409 representatives within the required time.
417410 (d) All requirements of the constitution and laws of this
418411 state and the rules and procedures of the legislature with respect
419412 to the notice, introduction, and passage of this Act are fulfilled
420413 and accomplished.
421414 SECTION 4. (a) If this Act does not receive a two-thirds
422415 vote of all the members elected to each house, Subchapter C, Chapter
423416 7927, Special District Local Laws Code, as added by Section 1 of
424417 this Act, is amended by adding Section 7927.106 to read as follows:
425418 Sec. 7927.106. NO EMINENT DOMAIN POWER. The district may
426419 not exercise the power of eminent domain.
427420 (b) This section is not intended to be an expression of a
428421 legislative interpretation of the requirements of Section 17(c),
429422 Article I, Texas Constitution.
430423 SECTION 5. This Act takes effect September 1, 2015.
