A BILL TO BE ENTITLED
AN ACT
relating to civil liability of the board of directors of the Brazos
Valley Groundwater Conservation District.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 8835, Special District
Local Laws Code, is amended by adding Section 8835.056 to read as
follows:
Sec. 8835.056. LIABILITY. Notwithstanding Section
101.001(2), Civil Practice and Remedies Code, for liability
purposes only, a director is considered an employee under Chapter
101, Civil Practice and Remedies Code.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
