215 Municipal Utility District No. 146; granting a limited power of
226 eminent domain; providing authority to issue bonds; providing
237 authority to impose assessments, fees, and taxes.
248 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
259 SECTION 1. Subtitle F, Title 6, Special District Local Laws
2610 Code, is amended by adding Chapter 7906 to read as follows:
2711 CHAPTER 7906. MONTGOMERY-GRIMES COUNTIES MUNICIPAL UTILITY
2812 DISTRICT NO. 146
2913 SUBCHAPTER A. GENERAL PROVISIONS
3014 Sec. 7906.001. DEFINITIONS. In this chapter:
3115 (1) "Board" means the district's board of directors.
3216 (2) "Commission" means the Texas Commission on
3317 Environmental Quality.
3418 (3) "Director" means a board member.
3519 (4) "District" means the Montgomery-Grimes Counties
3620 Municipal Utility District No. 146.
3721 Sec. 7906.002. NATURE OF DISTRICT. The district is a
3822 municipal utility district created under Section 59, Article XVI,
3923 Texas Constitution.
4024 Sec. 7906.003. CONFIRMATION AND DIRECTORS' ELECTION
4125 REQUIRED. The temporary directors shall hold an election to
4226 confirm the creation of the district and to elect five permanent
4327 directors as provided by Section 49.102, Water Code.
4428 Sec. 7906.004. CONSENT OF MUNICIPALITY REQUIRED. (a) The
4529 temporary directors may not hold an election under Section 7906.003
4630 until each municipality in whose corporate limits or
4731 extraterritorial jurisdiction the district is located has
4832 consented by ordinance or resolution to the creation of the
4933 district and to the inclusion of land in the district.
5034 (b) Municipal consent to the creation of the district and to
5135 the inclusion of land in the district granted under this section
5236 acts as municipal consent to the creation of any new district
5337 created by the division of the district and to the inclusion of land
5438 in the new district.
5539 Sec. 7906.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
5640 The district is created to serve a public purpose and benefit.
5741 (b) The district is created to accomplish the purposes of:
5842 (1) a municipal utility district as provided by
5943 general law and Section 59, Article XVI, Texas Constitution; and
6044 (2) Section 52, Article III, Texas Constitution, that
6145 relate to the construction, acquisition, improvement, operation,
6246 or maintenance of macadamized, graveled, or paved roads, or
6347 improvements, including storm drainage, in aid of those roads.
6448 Sec. 7906.006. INITIAL DISTRICT TERRITORY. (a) The
6549 district is initially composed of the territory described by
6650 Section 2 of the Act enacting this chapter.
6751 (b) The boundaries and field notes contained in Section 2 of
6852 the Act enacting this chapter form a closure. A mistake made in the
6953 field notes or in copying the field notes in the legislative process
7054 does not affect the district's:
7155 (1) organization, existence, or validity;
7256 (2) right to issue any type of bond for the purposes
7357 for which the district is created or to pay the principal of and
7458 interest on a bond;
7559 (3) right to impose a tax; or
7660 (4) legality or operation.
7761 SUBCHAPTER B. BOARD OF DIRECTORS
7862 Sec. 7906.051. GOVERNING BODY; TERMS. (a) The district is
7963 governed by a board of five elected directors.
8064 (b) Except as provided by Section 7906.052, directors serve
8165 staggered four-year terms.
8266 Sec. 7906.052. TEMPORARY DIRECTORS. (a) On or after
8367 September 1, 2015, the owner or owners of a majority of the assessed
8468 value of the real property in the district may submit a petition to
8569 the commission requesting that the commission appoint as temporary
8670 directors the five persons named in the petition. The commission
8771 shall appoint as temporary directors the five persons named in the
8872 petition.
8973 (b) Temporary directors serve until the earlier of:
9074 (1) the date permanent directors are elected under
9175 Section 7906.003; or
9276 (2) September 1, 2019.
9377 (c) If permanent directors have not been elected under
9478 Section 7906.003 and the terms of the temporary directors have
9579 expired, successor temporary directors shall be appointed or
9680 reappointed as provided by Subsection (d) to serve terms that
9781 expire on the earlier of:
9882 (1) the date permanent directors are elected under
9983 Section 7906.003; or
10084 (2) the fourth anniversary of the date of the
10185 appointment or reappointment.
10286 (d) If Subsection (c) applies, the owner or owners of a
10387 majority of the assessed value of the real property in the district
10488 may submit a petition to the commission requesting that the
10589 commission appoint as successor temporary directors the five
10690 persons named in the petition. The commission shall appoint as
10791 successor temporary directors the five persons named in the
10892 petition.
10993 SUBCHAPTER C. POWERS AND DUTIES
11094 Sec. 7906.101. GENERAL POWERS AND DUTIES. The district has
11195 the powers and duties necessary to accomplish the purposes for
11296 which the district is created.
11397 Sec. 7906.102. MUNICIPAL UTILITY DISTRICT POWERS AND
11498 DUTIES. The district has the powers and duties provided by the
11599 general law of this state, including Chapters 49 and 54, Water Code,
116100 applicable to municipal utility districts created under Section 59,
117101 Article XVI, Texas Constitution.
118102 Sec. 7906.103. AUTHORITY FOR ROAD PROJECTS. Under Section
119103 52, Article III, Texas Constitution, the district may design,
120104 acquire, construct, finance, issue bonds for, improve, operate,
121105 maintain, and convey to this state, a county, or a municipality for
122106 operation and maintenance macadamized, graveled, or paved roads, or
123107 improvements, including storm drainage, in aid of those roads.
124108 Sec. 7906.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
125109 project must meet all applicable construction standards, zoning and
126110 subdivision requirements, and regulations of each municipality in
127111 whose corporate limits or extraterritorial jurisdiction the road
128112 project is located.
129113 (b) If a road project is not located in the corporate limits
130114 or extraterritorial jurisdiction of a municipality, the road
131115 project must meet all applicable construction standards,
132116 subdivision requirements, and regulations of each county in which
133117 the road project is located.
134118 (c) If the state will maintain and operate the road, the
135119 Texas Transportation Commission must approve the plans and
136120 specifications of the road project.
137121 Sec. 7906.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
138122 OR RESOLUTION. (a) The district shall comply with all applicable
139123 requirements of any ordinance or resolution that is adopted under
140124 Section 54.016 or 54.0165, Water Code, and that consents to the
141125 creation of the district or to the inclusion of land in the
142126 district.
143127 (b) Section 54.016(f), Water Code, does not apply to the
144128 district.
145129 Sec. 7906.106. DIVISION OF DISTRICT. (a) The district may
146130 be divided into two or more new districts only if the district:
147131 (1) has no outstanding bonded debt; and
148132 (2) is not imposing ad valorem taxes.
149133 (b) This chapter applies to any new district created by the
150134 division of the district, and a new district has all the powers and
151135 duties of the district.
152136 (c) Any new district created by the division of the district
153137 may not, at the time the new district is created, contain any land
154138 outside the area described by Section 2 of the Act creating this
155139 chapter.
156140 (d) The board, on its own motion or on receipt of a petition
157141 signed by the owner or owners of a majority of the assessed value of
158142 the real property in the district, may adopt an order dividing the
159143 district.
160144 (e) The board may adopt an order dividing the district
161145 before or after the date the board holds an election under Section
162146 7906.003 to confirm the creation of the district and before or after
163147 an election under Section 7906.151 to authorize the issuance of
164148 bonds.
165149 (f) An order dividing the district must:
166150 (1) name each new district;
167151 (2) include the metes and bounds description of the
168152 territory of each new district;
169153 (3) appoint temporary directors for each new district;
170154 and
171155 (4) provide for the division of assets and liabilities
172156 between or among the new districts.
173157 (g) On or before the 30th day after the date of adoption of
174158 an order dividing the district, the district shall file the order
175159 with the commission and record the order in the real property
176160 records of each county in which the district is located.
177161 (h) Any new district created by the division of the district
178162 shall hold a confirmation and directors' election as required by
179163 Section 7906.003.
180164 (i) Any new district created by the division of the district
181165 must hold an election as required by this chapter to obtain voter
182166 approval before the district may impose a maintenance tax or issue
183167 bonds payable wholly or partly from ad valorem taxes.
184168 (j) If the creation of the new district is confirmed, the
185169 new district shall provide the election date and results to the
186170 commission.
187171 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
188172 Sec. 7906.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
189173 district may issue, without an election, bonds and other
190174 obligations secured by:
191175 (1) revenue other than ad valorem taxes; or
192176 (2) contract payments described by Section 7906.153.
193177 (b) The district must hold an election in the manner
194178 provided by Chapters 49 and 54, Water Code, to obtain voter approval
195179 before the district may impose an ad valorem tax or issue bonds
196180 payable from ad valorem taxes.
197181 (c) The district may not issue bonds payable from ad valorem
198182 taxes to finance a road project unless the issuance is approved by a
199183 vote of a two-thirds majority of the district voters voting at an
200184 election held for that purpose.
201185 Sec. 7906.152. OPERATION AND MAINTENANCE TAX. (a) If
202186 authorized at an election held under Section 7906.151, the district
203187 may impose an operation and maintenance tax on taxable property in
204188 the district in accordance with Section 49.107, Water Code.
205189 (b) The board shall determine the tax rate. The rate may not
206190 exceed the rate approved at the election.
207191 Sec. 7906.153. CONTRACT TAXES. (a) In accordance with
208192 Section 49.108, Water Code, the district may impose a tax other than
209193 an operation and maintenance tax and use the revenue derived from
210194 the tax to make payments under a contract after the provisions of
211195 the contract have been approved by a majority of the district voters
212196 voting at an election held for that purpose.
213197 (b) A contract approved by the district voters may contain a
214198 provision stating that the contract may be modified or amended by
215199 the board without further voter approval.
216200 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
217201 Sec. 7906.201. AUTHORITY TO ISSUE BONDS AND OTHER
218202 OBLIGATIONS. The district may issue bonds or other obligations
219203 payable wholly or partly from ad valorem taxes, impact fees,
220204 revenue, contract payments, grants, or other district money, or any
221205 combination of those sources, to pay for any authorized district
222206 purpose.
223207 Sec. 7906.202. TAXES FOR BONDS. At the time the district
224208 issues bonds payable wholly or partly from ad valorem taxes, the
225209 board shall provide for the annual imposition of a continuing
226210 direct ad valorem tax, without limit as to rate or amount, while all
227211 or part of the bonds are outstanding as required and in the manner
228212 provided by Sections 54.601 and 54.602, Water Code.
229213 Sec. 7906.203. BONDS FOR ROAD PROJECTS. At the time of
230214 issuance, the total principal amount of bonds or other obligations
231215 issued or incurred to finance road projects and payable from ad
232216 valorem taxes may not exceed one-fourth of the assessed value of the
233217 real property in the district.
234218 SECTION 2. The Montgomery-Grimes Counties Municipal
235219 Utility District No. 146 initially includes all the territory
236220 contained in the following area:
237221 428.212 Acres
238222 Joseph G. Ferguson Survey, A-221
239223 Montgomery County, Texas
240224 Being 428.212 acres of land situated in the Joseph G. Ferguson
241225 Survey, A-221, Montgomery County, Texas, and being out of a
242226 residual of a certain 1936.077 acres of land as described in deed
243227 recorded under County Clerk's File No. 2007-037712 of the Real
244228 Property Records of Montgomery County, Texas, said 428.212 acres of
245229 land being more particularly described by metes and bounds as
246230 follows:
247231 BEGINNING at a concrete monument found in the west line of F.M.
248232 1486, a 110 foot right-of-way, for the southeast corner of Blake
249233 Ranch as described in deed recorded under County Clerk's File
250234 No. 9366055 of the Real Property Records of Montgomery County,
251235 Texas, same being the northeast corner and POINT OF BEGINNING of
252236 the herein described tract;
253237 THENCE South 02 degrees 33 minutes 01 seconds East, along the west
254238 line of said F.M. 1486 and the east boundary line of the said
255239 1936.077 acres of land, same being the east boundary line of the
256240 herein described tract, a distance of 2677.01 feet to a 5/8 inch
257241 iron rod with survey cap (Moyer) set for the northeast corner of Lot
258242 1, Block 8, Crown Ranch Section One Amending Plat No. 1, according
259243 to the map or plat thereof recorded in Cabinet Z, Sheets 755 thru
260244 759 of the Map Records of Montgomery County, Texas, and the
261245 southeast corner of the herein described tract;
262246 THENCE North 85 degrees 35 minutes 50 seconds West, along the north
263247 boundary line of Lots 1, 2, 3, and 4, Block 8, of said Crown Ranch
264248 and the southerly boundary line of the herein described tract, a
265249 distance of 1128.30 feet to a 5/8 inch iron rod with survey cap
266250 (Moyer) set for an angle point;
267251 THENCE South 59 degrees 34 minutes 02 seconds West, continuing
268252 along the north boundary line of said Lot 4 and the north boundary
269253 line of Lots 5 and 6, Block 8 of said Crown Ranch and continuing
270254 along the south boundary line of the herein described tract, a
271255 distance of 635.56 feet to a 5/8 inch iron rod with survey cap
272256 (Moyer) set for the northwest corner of said Lot 6 and a southerly

705689 (c) The Texas Commission on Environmental Quality has filed
706690 its recommendations relating to this Act with the governor, the

709693 (d) All requirements of the constitution and laws of this
710694 state and the rules and procedures of the legislature with respect
711695 to the notice, introduction, and passage of this Act are fulfilled
712696 and accomplished.
713697 SECTION 4. (a) If this Act does not receive a two-thirds
714698 vote of all the members elected to each house, Subchapter C, Chapter
715699 7906, Special District Local Laws Code, as added by Section 1 of
716700 this Act, is amended by adding Section 7906.107 to read as follows:
717701 Sec. 7906.107. NO EMINENT DOMAIN POWER. The district may
718702 not exercise the power of eminent domain.
719703 (b) This section is not intended to be an expression of a
720704 legislative interpretation of the requirements of Section 17(c),
721705 Article I, Texas Constitution.
722706 SECTION 5. This Act takes effect September 1, 2015.
