114 relating to the creation of the Bell County Municipal Utility
125 District No. 3; granting a limited power of eminent domain;
136 providing authority to issue bonds; providing authority to impose
147 assessments, fees, and taxes.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1710 Code, is amended by adding Chapter 7936 to read as follows:
1811 CHAPTER 7936. BELL COUNTY MUNICIPAL UTILITY DISTRICT NO. 3
1912 SUBCHAPTER A. GENERAL PROVISIONS
2013 Sec. 7936.001. DEFINITIONS. In this chapter:
2114 (1) "Board" means the district's board of directors.
2215 (2) "Commission" means the Texas Commission on
2316 Environmental Quality.
2417 (3) "Director" means a board member.
2518 (4) "District" means the Bell County Municipal Utility
2619 District No. 3.
2720 Sec. 7936.002. NATURE OF DISTRICT. The district is a
2821 municipal utility district created under Section 59, Article XVI,
2922 Texas Constitution.
3023 Sec. 7936.003. CONFIRMATION AND DIRECTORS' ELECTION
3124 REQUIRED. The temporary directors shall hold an election to
3225 confirm the creation of the district and to elect five permanent
3326 directors as provided by Section 49.102, Water Code.
3427 Sec. 7936.004. CONSENT OF MUNICIPALITY REQUIRED. The
3528 temporary directors may not hold an election under Section 7936.003
3629 until each municipality in whose corporate limits or
3730 extraterritorial jurisdiction the district is located has
3831 consented by ordinance or resolution to the creation of the
3932 district and to the inclusion of land in the district.
4033 Sec. 7936.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4134 The district is created to serve a public purpose and benefit.
4235 (b) The district is created to accomplish the purposes of:
4336 (1) a municipal utility district as provided by
4437 general law and Section 59, Article XVI, Texas Constitution; and
4538 (2) Section 52, Article III, Texas Constitution, that
4639 relate to the construction, acquisition, improvement, operation,
4740 or maintenance of macadamized, graveled, or paved roads, or
4841 improvements, including storm drainage, in aid of those roads.
4942 Sec. 7936.006. INITIAL DISTRICT TERRITORY. (a) The
5043 district is initially composed of the territory described by
5144 Section 2 of the Act enacting this chapter.
5245 (b) The boundaries and field notes contained in Section 2 of
5346 the Act enacting this chapter form a closure. A mistake made in the
5447 field notes or in copying the field notes in the legislative process
5548 does not affect the district's:
5649 (1) organization, existence, or validity;
5750 (2) right to issue any type of bond for the purposes
5851 for which the district is created or to pay the principal of and
5952 interest on a bond;
6053 (3) right to impose a tax; or
6154 (4) legality or operation.
6255 SUBCHAPTER B. BOARD OF DIRECTORS
6356 Sec. 7936.051. GOVERNING BODY; TERMS. (a) The district is
6457 governed by a board of five elected directors.
6558 (b) Except as provided by Section 7936.052, directors serve
6659 staggered four-year terms.
6760 Sec. 7936.052. TEMPORARY DIRECTORS. (a) On or after the
6861 effective date of the Act enacting this chapter, the owner or owners
6962 of a majority of the assessed value of the real property in the
7063 district may submit a petition to the commission requesting that
7164 the commission appoint as temporary directors the five persons
7265 named in the petition. The commission shall appoint as temporary
7366 directors the five persons named in the petition.
7467 (b) Temporary directors serve until the earlier of:
7568 (1) the date permanent directors are elected under
7669 Section 7936.003; or
7770 (2) the fourth anniversary of the effective date of
7871 the Act enacting this chapter.
7972 (c) If permanent directors have not been elected under
8073 Section 7936.003 and the terms of the temporary directors have
8174 expired, successor temporary directors shall be appointed or
8275 reappointed as provided by Subsection (d) to serve terms that
8376 expire on the earlier of:
8477 (1) the date permanent directors are elected under
8578 Section 7936.003; or
8679 (2) the fourth anniversary of the date of the
8780 appointment or reappointment.
8881 (d) If Subsection (c) applies, the owner or owners of a
8982 majority of the assessed value of the real property in the district
9083 may submit a petition to the commission requesting that the
9184 commission appoint as successor temporary directors the five
9285 persons named in the petition. The commission shall appoint as
9386 successor temporary directors the five persons named in the
9487 petition.
9588 SUBCHAPTER C. POWERS AND DUTIES
9689 Sec. 7936.101. GENERAL POWERS AND DUTIES. The district has
9790 the powers and duties necessary to accomplish the purposes for
9891 which the district is created.
9992 Sec. 7936.102. MUNICIPAL UTILITY DISTRICT POWERS AND
10093 DUTIES. The district has the powers and duties provided by the
10194 general law of this state, including Chapters 49 and 54, Water Code,
10295 applicable to municipal utility districts created under Section 59,
10396 Article XVI, Texas Constitution.
10497 Sec. 7936.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10598 52, Article III, Texas Constitution, the district may design,
10699 acquire, construct, finance, issue bonds for, improve, operate,
107100 maintain, and convey to this state, a county, or a municipality for
108101 operation and maintenance macadamized, graveled, or paved roads, or
109102 improvements, including storm drainage, in aid of those roads.
110103 Sec. 7936.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
111104 project must meet all applicable construction standards, zoning and
112105 subdivision requirements, and regulations of each municipality in
113106 whose corporate limits or extraterritorial jurisdiction the road
114107 project is located.
115108 (b) If a road project is not located in the corporate limits
116109 or extraterritorial jurisdiction of a municipality, the road
117110 project must meet all applicable construction standards,
118111 subdivision requirements, and regulations of each county in which
119112 the road project is located.
120113 (c) If the state will maintain and operate the road, the
121114 Texas Transportation Commission must approve the plans and
122115 specifications of the road project.
123116 Sec. 7936.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
124117 OR RESOLUTION. The district shall comply with all applicable
125118 requirements of any ordinance or resolution that is adopted under
126119 Section 54.016 or 54.0165, Water Code, and that consents to the
127120 creation of the district or to the inclusion of land in the
128121 district.
129122 Sec. 7936.106. DIVISION OF DISTRICT. (a) The district may
130123 be divided into two or more districts only if:
131124 (1) the district has no outstanding bonded debt;
132125 (2) the district is not imposing ad valorem taxes; and
133126 (3) the requirements of Subsection (i), as applicable,
134127 are satisfied.
135128 (b) This chapter applies to any new district created by the
136129 division of the district, and a new district has all the powers and
137130 duties of the district.
138131 (c) A new district created by the division of the district
139132 may not, at the time the new district is created, contain any land
140133 outside the area described by Section 2 of the Act creating this
141134 chapter.
142135 (d) The board, on its own motion or on receipt of a petition
143136 signed by the owner or owners of a majority of the assessed value of
144137 the real property in the district, may adopt an order dividing the
145138 district.
146139 (e) The board may adopt an order dividing the district
147140 before or after the date the board holds an election under Section
148141 7936.003 to confirm the district's creation.
149142 (f) An order dividing the district shall:
150143 (1) name each new district;
151144 (2) include the metes and bounds of each new district;
152145 (3) appoint temporary directors for each new district;
153146 and
154147 (4) provide for the division of assets and liabilities
155148 between the district and each new district.
156149 (g) On or before the 30th day after the date of adoption of
157150 an order dividing the district, the district shall file the order
158151 with the Texas Commission on Environmental Quality and record the
159152 order in the real property records of each county in which the
160153 district is located.
161154 (h) A new district created by the division of the district
162155 shall hold a confirmation and directors' election as required by
163156 Section 7936.003.
164157 (i) If the district is located wholly or partly in the
165158 corporate limits or the extraterritorial jurisdiction of a
166159 municipality, the district may not divide under this section unless
167160 the municipality by resolution or ordinance consents to the
168161 division of the district. If the district is not located wholly or
169162 partly in the corporate limits or extraterritorial jurisdiction of
170163 a municipality, the district may not divide under this section
171164 unless the commissioners court of each county in which the district
172165 is wholly or partly located first adopts a resolution or order in
173166 support of the division of the district.
174167 (j) Any new district created by the division of the district
175168 must hold an election as required by this chapter to obtain voter
176169 approval before the district may impose a maintenance tax or issue
177170 bonds payable wholly or partly from ad valorem taxes.
178171 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
179172 Sec. 7936.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
180173 district may issue, without an election, bonds and other
181174 obligations secured by:
182175 (1) revenue other than ad valorem taxes; or
183176 (2) contract payments described by Section 7936.153.
184177 (b) The district must hold an election in the manner
185178 provided by Chapters 49 and 54, Water Code, to obtain voter approval
186179 before the district may impose an ad valorem tax or issue bonds
187180 payable from ad valorem taxes.
188181 (c) The district may not issue bonds payable from ad valorem
189182 taxes to finance a road project unless the issuance is approved by a
190183 vote of a two-thirds majority of the district voters voting at an
191184 election held for that purpose.
192185 Sec. 7936.152. OPERATION AND MAINTENANCE TAX. (a) If
193186 authorized at an election held under Section 7936.151, the district
194187 may impose an operation and maintenance tax on taxable property in
195188 the district in accordance with Section 49.107, Water Code.
196189 (b) The board shall determine the tax rate. The rate may not
197190 exceed the rate approved at the election.
198191 Sec. 7936.153. CONTRACT TAXES. (a) In accordance with
199192 Section 49.108, Water Code, the district may impose a tax other than
200193 an operation and maintenance tax and use the revenue derived from
201194 the tax to make payments under a contract after the provisions of
202195 the contract have been approved by a majority of the district voters
203196 voting at an election held for that purpose.
204197 (b) A contract approved by the district voters may contain a
205198 provision stating that the contract may be modified or amended by
206199 the board without further voter approval.
207200 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
208201 Sec. 7936.201. AUTHORITY TO ISSUE BONDS AND OTHER
209202 OBLIGATIONS. The district may issue bonds or other obligations
210203 payable wholly or partly from ad valorem taxes, impact fees,
211204 revenue, contract payments, grants, or other district money, or any
212205 combination of those sources, to pay for any authorized district
213206 purpose.
214207 Sec. 7936.202. TAXES FOR BONDS. At the time the district
215208 issues bonds payable wholly or partly from ad valorem taxes, the
216209 board shall provide for the annual imposition of a continuing
217210 direct ad valorem tax, without limit as to rate or amount, while all
218211 or part of the bonds are outstanding as required and in the manner
219212 provided by Sections 54.601 and 54.602, Water Code.
220213 Sec. 7936.203. BONDS FOR ROAD PROJECTS. At the time of
221214 issuance, the total principal amount of bonds or other obligations
222215 issued or incurred to finance road projects and payable from ad
223216 valorem taxes may not exceed one-fourth of the assessed value of the
224217 real property in the district.
225218 SECTION 2. The Bell County Municipal Utility District No. 3
226219 initially includes all the territory contained in the following
227220 area:
228221 1221.63 ACRES, situated in the J. GREENWOOD SURVEY, ABSTRACT
229222 367, the D. F. HAIR SURVEY, ABSTRACT 1088, the CYNTHIA GILBERT
230223 SURVEY, ABSTRACT 346, the J. KIZZIER SURVEY, ABSTRACT 496, the W. S.
231224 BLACK SURVEY, ABSTRACT 128, and the PRESTON CONLEY SURVEY, ABSTRACT
232225 213, Bell County, Texas, embracing all of a called 425.18 Acre tract
233226 conveyed as Tract One, all of a called 382.61 Acre tract, conveyed
234227 as Tract Two, and all of a called 413.72 Acre tract, conveyed as

390383 SECTION 3. (a) The legal notice of the intention to
391384 introduce this Act, setting forth the general substance of this
392385 Act, has been published as provided by law, and the notice and a
393386 copy of this Act have been furnished to all persons, agencies,
394387 officials, or entities to which they are required to be furnished
395388 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
396389 Government Code.
397390 (b) The governor, one of the required recipients, has
398391 submitted the notice and Act to the Texas Commission on
399392 Environmental Quality.
400393 (c) The Texas Commission on Environmental Quality has filed
401394 its recommendations relating to this Act with the governor, the
402395 lieutenant governor, and the speaker of the house of
403396 representatives within the required time.
404397 (d) All requirements of the constitution and laws of this
405398 state and the rules and procedures of the legislature with respect
406399 to the notice, introduction, and passage of this Act are fulfilled
407400 and accomplished.
408401 SECTION 4. (a) If this Act does not receive a two-thirds
409402 vote of all the members elected to each house, Subchapter C, Chapter
410403 7936, Special District Local Laws Code, as added by Section 1 of
411404 this Act, is amended by adding Section 7936.107 to read as follows:
412405 Sec. 7936.107. NO EMINENT DOMAIN POWER. The district may
413406 not exercise the power of eminent domain.
414407 (b) This section is not intended to be an expression of a
415408 legislative interpretation of the requirements of Section 17(c),
416409 Article I, Texas Constitution.
417410 SECTION 5. This Act takes effect immediately if it receives
418411 a vote of two-thirds of all the members elected to each house, as
419412 provided by Section 39, Article III, Texas Constitution. If this
420413 Act does not receive the vote necessary for immediate effect, this
421414 Act takes effect September 1, 2015.
