104 AN ACT
115 relating to the territory, board, and operation of the Lake Cities
126 Municipal Utility Authority.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 3(a), Chapter 1137, Acts of the 76th
159 Legislature, Regular Session, 1999, is amended to read as follows:
1610 (a) LCMUA consists of the territory, as specifically
1711 described in the official records of LCMUA, that is contained in the
1812 boundaries or extraterritorial jurisdiction of:
1913 (1) the City of Lake Dallas;
2014 (2) the Town [and that part of the City] of Shady
2115 Shores; and
2216 (3) the Town of Hickory Creek [specifically described
2317 in the official records of LCMUA].
2418 SECTION 2. Section 6, Chapter 1137, Acts of the 76th
2519 Legislature, Regular Session, 1999, is amended by adding Subsection
2620 (d-1) to read as follows:
2721 (d-1) The director for:
2822 (1) place 1 must reside in the City of Lake Dallas or
2923 its extraterritorial jurisdiction;
3024 (2) place 2 must reside within the boundaries of
3125 LCMUA;
3226 (3) place 3 must reside in the Town of Shady Shores or
3327 its extraterritorial jurisdiction;
3428 (4) place 4 must reside within the boundaries of
3529 LCMUA; and
3630 (5) place 5 must reside in the Town of Hickory Creek or
3731 its extraterritorial jurisdiction.
3832 SECTION 3. Section 7(a), Chapter 1137, Acts of the 76th
3933 Legislature, Regular Session, 1999, is amended to read as follows:
4034 (a) The board shall elect from its number a president and
4135 vice president and any other officers the board considers necessary
4236 or appropriate. Not more than two officers may reside in the same
4337 municipality.
4438 SECTION 4. Section 13(d), Chapter 1137, Acts of the 76th
4539 Legislature, Regular Session, 1999, is amended to read as follows:
4640 (d) LCMUA may apply as necessary for any permit, license, or
4741 other authorization from the Texas [Natural Resource Conservation]
4842 Commission on Environmental Quality or any other regulatory body in
4943 order to conduct any of its operations.
5044 SECTION 5. Sections 16(c) and (l), Chapter 1137, Acts of the
5145 76th Legislature, Regular Session, 1999, are amended to read as
5246 follows:
5347 (c) Bonds shall be issued in the name of Lake Cities
5448 Municipal Utility Authority and[,] signed by the president or vice
5549 president[, and attested by the secretary] and shall bear the seal,
5650 or a facsimile seal, of LCMUA. The facsimile signature of the
5751 president or vice president [secretary] or both may be printed or
5852 lithographed on the bonds if authorized by the board, and the seal
5953 of LCMUA may be impressed, printed, or lithographed on the bonds.
6054 (l) Any provision in this Act to the contrary
6155 notwithstanding, before issuing any construction bonds, LCMUA
6256 shall submit plans, specifications, and other necessary
6357 information and documents to the appropriate authorities and shall
6458 obtain the necessary permits or other authorizations from the
6559 appropriate regulatory bodies, including the Texas [Natural
6660 Resource Conservation] Commission on Environmental Quality.
6761 SECTION 6. Section 7(d), Chapter 1137, Acts of the 76th
6862 Legislature, Regular Session, 1999, is repealed.
6963 SECTION 7. Section 6(d-1), Chapter 1137, Acts of the 76th
7064 Legislature, Regular Session, 1999, as added by this Act, does not
7165 affect the entitlement of a member serving on the board of directors
7266 of the Lake Cities Municipal Utility Authority immediately before
7367 the effective date of this Act to continue to carry out the board's
7468 functions for the remainder of the member's term. The changes in
7569 law apply only to a member elected on or after the effective date of
7670 this Act. This Act does not prohibit a person who is a member of the
7771 board on the effective date of this Act from being reelected to the
7872 board if the person has the qualifications required for a member
7973 under Section 6(d-1), Chapter 1137, Acts of the 76th Legislature,
8074 Regular Session, 1999, as added by this Act.
8175 SECTION 8. (a) The legal notice of the intention to
8276 introduce this Act, setting forth the general substance of this
8377 Act, has been published as provided by law, and the notice and a
8478 copy of this Act have been furnished to all persons, agencies,
8579 officials, or entities to which they are required to be furnished
8680 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
8781 Government Code.
8882 (b) The governor, one of the required recipients, has
8983 submitted the notice and Act to the Texas Commission on
9084 Environmental Quality.
9185 (c) The Texas Commission on Environmental Quality has filed
9286 its recommendations relating to this Act with the governor, the
9387 lieutenant governor, and the speaker of the house of
9488 representatives within the required time.
9589 (d) All requirements of the constitution and laws of this
9690 state and the rules and procedures of the legislature with respect
9791 to the notice, introduction, and passage of this Act are fulfilled
9892 and accomplished.
9993 SECTION 9. This Act takes effect September 1, 2015.
