10	4		AN ACT
11	5		relating to the territory, board, and operation of the Lake Cities
12	6		Municipal Utility Authority.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. Section 3(a), Chapter 1137, Acts of the 76th
15	9		Legislature, Regular Session, 1999, is amended to read as follows:
16	10		(a) LCMUA consists of the territory, as specifically
17	11		described in the official records of LCMUA, that is contained in the
18	12		boundaries or extraterritorial jurisdiction of:
19	13		(1) the City of Lake Dallas;
20	14		(2) the Town [and that part of the City] of Shady
21	15		Shores; and
22	16		(3) the Town of Hickory Creek [specifically described
23	17		in the official records of LCMUA].
24	18		SECTION 2. Section 6, Chapter 1137, Acts of the 76th
25	19		Legislature, Regular Session, 1999, is amended by adding Subsection
26	20		(d-1) to read as follows:
27	21		(d-1) The director for:
28	22		(1) place 1 must reside in the City of Lake Dallas or
29	23		its extraterritorial jurisdiction;
30	24		(2) place 2 must reside within the boundaries of
31	25		LCMUA;
32	26		(3) place 3 must reside in the Town of Shady Shores or
33	27		its extraterritorial jurisdiction;
34	28		(4) place 4 must reside within the boundaries of
35	29		LCMUA; and
36	30		(5) place 5 must reside in the Town of Hickory Creek or
37	31		its extraterritorial jurisdiction.
38	32		SECTION 3. Section 7(a), Chapter 1137, Acts of the 76th
39	33		Legislature, Regular Session, 1999, is amended to read as follows:
40	34		(a) The board shall elect from its number a president and
41	35		vice president and any other officers the board considers necessary
42	36		or appropriate. Not more than two officers may reside in the same
43	37		municipality.
44	38		SECTION 4. Section 13(d), Chapter 1137, Acts of the 76th
45	39		Legislature, Regular Session, 1999, is amended to read as follows:
46	40		(d) LCMUA may apply as necessary for any permit, license, or
47	41		other authorization from the Texas [Natural Resource Conservation]
48	42		Commission on Environmental Quality or any other regulatory body in
49	43		order to conduct any of its operations.
50	44		SECTION 5. Sections 16(c) and (l), Chapter 1137, Acts of the
51	45		76th Legislature, Regular Session, 1999, are amended to read as
52	46		follows:
53	47		(c) Bonds shall be issued in the name of Lake Cities
54	48		Municipal Utility Authority and[,] signed by the president or vice
55	49		president[, and attested by the secretary] and shall bear the seal,
56	50		or a facsimile seal, of LCMUA. The facsimile signature of the
57	51		president or vice president [secretary] or both may be printed or
58	52		lithographed on the bonds if authorized by the board, and the seal
59	53		of LCMUA may be impressed, printed, or lithographed on the bonds.
60	54		(l) Any provision in this Act to the contrary
61	55		notwithstanding, before issuing any construction bonds, LCMUA
62	56		shall submit plans, specifications, and other necessary
63	57		information and documents to the appropriate authorities and shall
64	58		obtain the necessary permits or other authorizations from the
65	59		appropriate regulatory bodies, including the Texas [Natural
66	60		Resource Conservation] Commission on Environmental Quality.
67	61		SECTION 6. Section 7(d), Chapter 1137, Acts of the 76th
68	62		Legislature, Regular Session, 1999, is repealed.
69	63		SECTION 7. Section 6(d-1), Chapter 1137, Acts of the 76th
70	64		Legislature, Regular Session, 1999, as added by this Act, does not
71	65		affect the entitlement of a member serving on the board of directors
72	66		of the Lake Cities Municipal Utility Authority immediately before
73	67		the effective date of this Act to continue to carry out the board's
74	68		functions for the remainder of the member's term. The changes in
75	69		law apply only to a member elected on or after the effective date of
76	70		this Act. This Act does not prohibit a person who is a member of the
77	71		board on the effective date of this Act from being reelected to the
78	72		board if the person has the qualifications required for a member
79	73		under Section 6(d-1), Chapter 1137, Acts of the 76th Legislature,
80	74		Regular Session, 1999, as added by this Act.
81	75		SECTION 8. (a) The legal notice of the intention to
82	76		introduce this Act, setting forth the general substance of this
83	77		Act, has been published as provided by law, and the notice and a
84	78		copy of this Act have been furnished to all persons, agencies,
85	79		officials, or entities to which they are required to be furnished
86	80		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
87	81		Government Code.
88	82		(b) The governor, one of the required recipients, has
89	83		submitted the notice and Act to the Texas Commission on
90	84		Environmental Quality.
91	85		(c) The Texas Commission on Environmental Quality has filed
92	86		its recommendations relating to this Act with the governor, the
93	87		lieutenant governor, and the speaker of the house of
94	88		representatives within the required time.
95	89		(d) All requirements of the constitution and laws of this
96	90		state and the rules and procedures of the legislature with respect
97	91		to the notice, introduction, and passage of this Act are fulfilled
98	92		and accomplished.
99	93		SECTION 9. This Act takes effect September 1, 2015.
