6	5		relating to the creation of the Williamson County Municipal Utility
7	6		District No. 32; granting a limited power of eminent domain;
8	7		providing authority to issue bonds; providing authority to impose
9	8		assessments, fees, and taxes.
10	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	10		SECTION 1. Subtitle F, Title 6, Special District Local Laws
12	11		Code, is amended by adding Chapter 7935 to read as follows:
13	12		CHAPTER 7935. WILLIAMSON COUNTY MUNICIPAL UTILITY DISTRICT NO. 32
14	13		SUBCHAPTER A. GENERAL PROVISIONS
15	14		Sec. 7935.001. DEFINITIONS. In this chapter:
16	15		(1) "Board" means the district's board of directors.
17	16		(2) "Commission" means the Texas Commission on
18	17		Environmental Quality.
19	18		(3) "Director" means a board member.
20	19		(4) "District" means the Williamson County Municipal
21	20		Utility District No. 32.
22	21		Sec. 7935.002. NATURE OF DISTRICT. The district is a
23	22		municipal utility district created under Section 59, Article XVI,
24	23		Texas Constitution.
25	24		Sec. 7935.003. CONFIRMATION AND DIRECTORS' ELECTION
26	25		REQUIRED. The temporary directors shall hold an election to
27	26		confirm the creation of the district and to elect five permanent
28	27		directors as provided by Section 49.102, Water Code.
29	28		Sec. 7935.004. CONSENT OF MUNICIPALITY REQUIRED. The
30	29		temporary directors may not hold an election under Section 7935.003
31	30		until each municipality in whose corporate limits or
32	31		extraterritorial jurisdiction the district is located has
33	32		consented by ordinance or resolution to the creation of the
34	33		district and to the inclusion of land in the district.
35	34		Sec. 7935.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
36	35		The district is created to serve a public purpose and benefit.
37	36		(b) The district is created to accomplish the purposes of:
38	37		(1) a municipal utility district as provided by
39	38		general law and Section 59, Article XVI, Texas Constitution; and
40	39		(2) Section 52, Article III, Texas Constitution, that
41	40		relate to the construction, acquisition, improvement, operation,
42	41		or maintenance of macadamized, graveled, or paved roads, or
43	42		improvements, including storm drainage, in aid of those roads.
44	43		Sec. 7935.006. INITIAL DISTRICT TERRITORY. (a) The
45	44		district is initially composed of the territory described by
46	45		Section 2 of the Act enacting this chapter.
47	46		(b) The boundaries and field notes contained in Section 2 of
48	47		the Act enacting this chapter form a closure. A mistake made in the
49	48		field notes or in copying the field notes in the legislative process
50	49		does not affect the district's:
51	50		(1) organization, existence, or validity;
52	51		(2) right to issue any type of bond for the purposes
53	52		for which the district is created or to pay the principal of and
54	53		interest on a bond;
55	54		(3) right to impose a tax; or
56	55		(4) legality or operation.
57	56		SUBCHAPTER B. BOARD OF DIRECTORS
58	57		Sec. 7935.051. GOVERNING BODY; TERMS. (a) The district is
59	58		governed by a board of five elected directors.
60	59		(b) Except as provided by Section 7935.052, directors serve
61	60		staggered four-year terms.
62	61		Sec. 7935.052. TEMPORARY DIRECTORS. (a) On or after the
63	62		effective date of the Act enacting this chapter, the owner or owners
64	63		of a majority of the assessed value of the real property in the
65	64		district may submit a petition to the commission requesting that
66	65		the commission appoint as temporary directors the five persons
67	66		named in the petition. The commission shall appoint as temporary
68	67		directors the five persons named in the petition.
69	68		(b) Temporary directors serve until the earlier of:
70	69		(1) the date permanent directors are elected under
71	70		Section 7935.003; or
72	71		(2) the fourth anniversary of the effective date of
73	72		the Act enacting this chapter.
74	73		(c) If permanent directors have not been elected under
75	74		Section 7935.003 and the terms of the temporary directors have
76	75		expired, successor temporary directors shall be appointed or
77	76		reappointed as provided by Subsection (d) to serve terms that
78	77		expire on the earlier of:
79	78		(1) the date permanent directors are elected under
80	79		Section 7935.003; or
81	80		(2) the fourth anniversary of the date of the
82	81		appointment or reappointment.
83	82		(d) If Subsection (c) applies, the owner or owners of a
84	83		majority of the assessed value of the real property in the district
85	84		may submit a petition to the commission requesting that the
86	85		commission appoint as successor temporary directors the five
87	86		persons named in the petition. The commission shall appoint as
88	87		successor temporary directors the five persons named in the
89	88		petition.
90	89		SUBCHAPTER C. POWERS AND DUTIES
91	90		Sec. 7935.101. GENERAL POWERS AND DUTIES. The district has
92	91		the powers and duties necessary to accomplish the purposes for
93	92		which the district is created.
94	93		Sec. 7935.102. MUNICIPAL UTILITY DISTRICT POWERS AND
95	94		DUTIES. The district has the powers and duties provided by the
96	95		general law of this state, including Chapters 49 and 54, Water Code,
97	96		applicable to municipal utility districts created under Section 59,
98	97		Article XVI, Texas Constitution.
99	98		Sec. 7935.103. AUTHORITY FOR ROAD PROJECTS. Under Section
100	99		52, Article III, Texas Constitution, the district may design,
101	100		acquire, construct, finance, issue bonds for, improve, operate,
102	101		maintain, and convey to this state, a county, or a municipality for
103	102		operation and maintenance macadamized, graveled, or paved roads, or
104	103		improvements, including storm drainage, in aid of those roads.
105	104		Sec. 7935.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
106	105		project must meet all applicable construction standards, zoning and
107	106		subdivision requirements, and regulations of each municipality in
108	107		whose corporate limits or extraterritorial jurisdiction the road
109	108		project is located.
110	109		(b) If a road project is not located in the corporate limits
111	110		or extraterritorial jurisdiction of a municipality, the road
112	111		project must meet all applicable construction standards,
113	112		subdivision requirements, and regulations of each county in which
114	113		the road project is located.
115	114		(c) If the state will maintain and operate the road, the
116	115		Texas Transportation Commission must approve the plans and
117	116		specifications of the road project.
118		-	(d) The district shall:
119		-	(1) maintain a connection between a road inside the
120		-	district and a public roadway that intersects a district boundary;
121		-	and
122		-	(2) at the request of a political subdivision adjacent
123		-	to the district or the Texas Department of Transportation, allow a
124		-	connection to be built between a road inside the district and a
125		-	public roadway that intersects a district boundary.
	117	+	(d) The district shall convey the public roads constructed
	118	+	by or on behalf of the district under Section 7935.103 to Williamson
	119	+	County for ownership, operation, and maintenance by the county.
	120	+	After the 12th anniversary of the date the county accepts
	121	+	conveyance of the roads, the district shall maintain the public
	122	+	roads located in the district, except that the county shall
	123	+	maintain the east-west arterial roadway located in the district
	124	+	north of the San Gabriel River and south of State Highway 29. The
	125	+	district's obligation to maintain the public roads located in the
	126	+	district ceases if all of the territory of the district is annexed
	127	+	by a municipality.
126	128		Sec. 7935.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
127	129		OR RESOLUTION. The district shall comply with all applicable
128	130		requirements of any ordinance or resolution that is adopted under
129	131		Section 54.016 or 54.0165, Water Code, and that consents to the
130	132		creation of the district or to the inclusion of land in the
131	133		district.
132	134		SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
133	135		Sec. 7935.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
134	136		district may issue, without an election, bonds and other
135	137		obligations secured by:
136	138		(1) revenue other than ad valorem taxes; or
137	139		(2) contract payments described by Section 7935.153.
138	140		(b) The district must hold an election in the manner
139	141		provided by Chapters 49 and 54, Water Code, to obtain voter approval
140	142		before the district may impose an ad valorem tax or issue bonds
141	143		payable from ad valorem taxes.
142	144		(c) The district may not issue bonds payable from ad valorem
143	145		taxes to finance a road project unless the issuance is approved by a
144	146		vote of a two-thirds majority of the district voters voting at an
145	147		election held for that purpose.
146	148		Sec. 7935.152. OPERATION AND MAINTENANCE TAX. (a) If
147	149		authorized at an election held under Section 7935.151, the district
148	150		may impose an operation and maintenance tax on taxable property in
149	151		the district in accordance with Section 49.107, Water Code.
150	152		(b) The board shall determine the tax rate. The rate may not
151	153		exceed the rate approved at the election.
152	154		Sec. 7935.153. CONTRACT TAXES. (a) In accordance with
153	155		Section 49.108, Water Code, the district may impose a tax other than
154	156		an operation and maintenance tax and use the revenue derived from
155	157		the tax to make payments under a contract after the provisions of
156	158		the contract have been approved by a majority of the district voters
157	159		voting at an election held for that purpose.
158	160		(b) A contract approved by the district voters may contain a
159	161		provision stating that the contract may be modified or amended by
160	162		the board without further voter approval.
161	163		SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
162	164		Sec. 7935.201. AUTHORITY TO ISSUE BONDS AND OTHER
163	165		OBLIGATIONS. The district may issue bonds or other obligations
164	166		payable wholly or partly from ad valorem taxes, impact fees,
165	167		revenue, contract payments, grants, or other district money, or any
166	168		combination of those sources, to pay for any authorized district
167	169		purpose.
168	170		Sec. 7935.202. TAXES FOR BONDS. At the time the district
169	171		issues bonds payable wholly or partly from ad valorem taxes, the
170	172		board shall provide for the annual imposition of a continuing
171	173		direct ad valorem tax, without limit as to rate or amount, while all
172	174		or part of the bonds are outstanding as required and in the manner
173	175		provided by Sections 54.601 and 54.602, Water Code.
174	176		Sec. 7935.203. BONDS FOR ROAD PROJECTS. At the time of
175	177		issuance, the total principal amount of bonds or other obligations
176	178		issued or incurred to finance road projects and payable from ad
177	179		valorem taxes may not exceed one-fourth of the assessed value of the
178	180		real property in the district.
179	181		SECTION 2. The Williamson County Municipal Utility District
180	182		No. 32 initially includes all the territory contained in the
181	183		following area:
182	184		BEING 224.01 ACRES OF LAND OUT OF THE WILLIAM H. MONROE
183	185		SURVEY, ABSTRACT NUMBER 453, AND THE HENRY GARMES SURVEY, ABSTRACT
184	186		NO. 269, BOTH IN WILLIAMSON COUNTY, TEXAS, AND BEING COMPRISED OF
185	187		TWO TRACTS: TRACT 1 BEING AN 85.28 ACRE REMAINDER OF AN 86.67 ACRE
186	188		TRACT, AND TRACT TWO BEING A PORTION OF A 217.19 ACRE TRACT, BOTH
187	189		CONVEYED TO LANCE ERIC CAUGHFIELD, TRUSTEE OF THE CAUGHFIELD FAMILY
188	190		TRUST BY CORRECTION GENERAL WARRANTY DEED OF RECORD IN DOC. NO.

391	393		SECTION 3. (a) The legal notice of the intention to
392	394		introduce this Act, setting forth the general substance of this
393	395		Act, has been published as provided by law, and the notice and a
394	396		copy of this Act have been furnished to all persons, agencies,
395	397		officials, or entities to which they are required to be furnished
396	398		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
397	399		Government Code.
398	400		(b) The governor, one of the required recipients, has
399	401		submitted the notice and Act to the Texas Commission on
400	402		Environmental Quality.
401	403		(c) The Texas Commission on Environmental Quality has filed
402	404		its recommendations relating to this Act with the governor, the
403	405		lieutenant governor, and the speaker of the house of
404	406		representatives within the required time.
405	407		(d) All requirements of the constitution and laws of this
406	408		state and the rules and procedures of the legislature with respect
407	409		to the notice, introduction, and passage of this Act are fulfilled
408	410		and accomplished.
409	411		SECTION 4. (a) If this Act does not receive a two-thirds
410	412		vote of all the members elected to each house, Subchapter C, Chapter
411	413		7935, Special District Local Laws Code, as added by Section 1 of
412	414		this Act, is amended by adding Section 7935.106 to read as follows:
413	415		Sec. 7935.106. NO EMINENT DOMAIN POWER. The district may
414	416		not exercise the power of eminent domain.
415	417		(b) This section is not intended to be an expression of a
416	418		legislative interpretation of the requirements of Section 17(c),
417	419		Article I, Texas Constitution.
418	420		SECTION 5. This Act takes effect immediately if it receives
419	421		a vote of two-thirds of all the members elected to each house, as
420	422		provided by Section 39, Article III, Texas Constitution. If this
421	423		Act does not receive the vote necessary for immediate effect, this
422	424		Act takes effect September 1, 2015.
