205 relating to renaming the Corn Hill Regional Water Authority as the
216 Lone Star Regional Water Authority; altering the governing body's
227 membership.
238 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
249 SECTION 1. The heading to Chapter 8364, Special District
2510 Local Laws Code, is amended to read as follows:
2611 CHAPTER 8364. LONE STAR [CORN HILL] REGIONAL WATER AUTHORITY
2712 SECTION 2. Section 8364.001(1), Special District Local Laws
2813 Code, is amended to read as follows:
2914 (1) "Authority" means the Lone Star [Corn Hill]
3015 Regional Water Authority.
3116 SECTION 3. Section 8364.051, Special District Local Laws
3217 Code, is amended by amending Subsection (c) and adding Subsection
3318 (e) to read as follows:
3419 (c) Except as provided by Subsection (e), each [Each] member
3520 entity shall appoint two directors.
3621 (e) If at any time the number of member entities is more than
3722 five, the board may adopt a resolution providing that each member
3823 entity shall appoint one director. A resolution adopted under this
3924 subsection must be approved by an affirmative vote of not less than
4025 75 percent of the directors then serving, with at least one director
4126 from each member entity present and voting in favor of the
4227 resolution. If the board passes a resolution under this subsection,
4328 the terms of the directors then serving shall expire on the first
4429 day of September following the date the resolution is adopted, and
4530 not later than the first day of October following the date the
4631 resolution is adopted, each member entity shall appoint one
4732 director.
4833 SECTION 4. (a) The legal notice of the intention to
4934 introduce this Act, setting forth the general substance of this
5035 Act, has been published as provided by law, and the notice and a
5136 copy of this Act have been furnished to all persons, agencies,
5237 officials, or entities to which they are required to be furnished
5338 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5439 Government Code.
5540 (b) The governor, one of the required recipients, has
5641 submitted the notice and Act to the Texas Commission on
5742 Environmental Quality.
5843 (c) The Texas Commission on Environmental Quality has filed
5944 its recommendations relating to this Act with the governor, the
6045 lieutenant governor, and the speaker of the house of
6146 representatives within the required time.
6247 (d) All requirements of the constitution and laws of this
6348 state and the rules and procedures of the legislature with respect
6449 to the notice, introduction, and passage of this Act are fulfilled
6550 and accomplished.
6651 SECTION 5. This Act takes effect immediately if it receives
6752 a vote of two-thirds of all the members elected to each house, as
6853 provided by Section 39, Article III, Texas Constitution. If this
6954 Act does not receive the vote necessary for immediate effect, this
7055 Act takes effect September 1, 2015.
