114 relating to the creation of the Williamson County Municipal Utility
125 District No. 33; granting a limited power of eminent domain;
136 providing authority to issue bonds; providing authority to impose
147 assessments, fees, and taxes.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1710 Code, is amended by adding Chapter 7959 to read as follows:
1811 CHAPTER 7959. WILLIAMSON COUNTY MUNICIPAL UTILITY DISTRICT NO. 33
1912 SUBCHAPTER A. GENERAL PROVISIONS
2013 Sec. 7959.001. DEFINITIONS. In this chapter:
2114 (1) "Board" means the district's board of directors.
2215 (2) "Commission" means the Texas Commission on
2316 Environmental Quality.
2417 (3) "Director" means a board member.
2518 (4) "District" means the Williamson County Municipal
2619 Utility District No. 33.
2720 Sec. 7959.002. NATURE OF DISTRICT. The district is a
2821 municipal utility district created under Section 59, Article XVI,
2922 Texas Constitution.
3023 Sec. 7959.003. CONFIRMATION AND DIRECTORS' ELECTION
3124 REQUIRED. The temporary directors shall hold an election to
3225 confirm the creation of the district and to elect five permanent
3326 directors as provided by Section 49.102, Water Code.
3427 Sec. 7959.004. CONSENT OF MUNICIPALITY REQUIRED. The
3528 temporary directors may not hold an election under Section 7959.003
3629 until each municipality in whose corporate limits or
3730 extraterritorial jurisdiction the district is located has
3831 consented by ordinance or resolution to the creation of the
3932 district and to the inclusion of land in the district.
4033 Sec. 7959.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4134 The district is created to serve a public purpose and benefit.
4235 (b) The district is created to accomplish the purposes of:
4336 (1) a municipal utility district as provided by
4437 general law and Section 59, Article XVI, Texas Constitution; and
4538 (2) Section 52, Article III, Texas Constitution, that
4639 relate to the construction, acquisition, improvement, operation,
4740 or maintenance of macadamized, graveled, or paved roads, or
4841 improvements, including storm drainage, in aid of those roads.
4942 Sec. 7959.006. INITIAL DISTRICT TERRITORY. (a) The
5043 district is initially composed of the territory described by
5144 Section 2 of the Act enacting this chapter.
5245 (b) The boundaries and field notes contained in Section 2 of
5346 the Act enacting this chapter form a closure. A mistake made in the
5447 field notes or in copying the field notes in the legislative process
5548 does not affect the district's:
5649 (1) organization, existence, or validity;
5750 (2) right to issue any type of bond for the purposes
5851 for which the district is created or to pay the principal of and
5952 interest on a bond;
6053 (3) right to impose a tax; or
6154 (4) legality or operation.
6255 SUBCHAPTER B. BOARD OF DIRECTORS
6356 Sec. 7959.051. GOVERNING BODY; TERMS. (a) The district is
6457 governed by a board of five elected directors.
6558 (b) Except as provided by Section 7959.052, directors serve
6659 staggered four-year terms.
6760 Sec. 7959.052. TEMPORARY DIRECTORS. (a) On or after the
6861 effective date of the Act enacting this chapter, the owner or owners
6962 of a majority of the assessed value of the real property in the
7063 district may submit a petition to the commission requesting that
7164 the commission appoint as temporary directors the five persons
7265 named in the petition. The commission shall appoint as temporary
7366 directors the five persons named in the petition.
7467 (b) Temporary directors serve until the earlier of:
7568 (1) the date permanent directors are elected under
7669 Section 7959.003; or
7770 (2) the fourth anniversary of the effective date of
7871 the Act enacting this chapter.
7972 (c) If permanent directors have not been elected under
8073 Section 7959.003 and the terms of the temporary directors have
8174 expired, successor temporary directors shall be appointed or
8275 reappointed as provided by Subsection (d) to serve terms that
8376 expire on the earlier of:
8477 (1) the date permanent directors are elected under
8578 Section 7959.003; or
8679 (2) the fourth anniversary of the date of the
8780 appointment or reappointment.
8881 (d) If Subsection (c) applies, the owner or owners of a
8982 majority of the assessed value of the real property in the district
9083 may submit a petition to the commission requesting that the
9184 commission appoint as successor temporary directors the five
9285 persons named in the petition. The commission shall appoint as
9386 successor temporary directors the five persons named in the
9487 petition.
9588 SUBCHAPTER C. POWERS AND DUTIES
9689 Sec. 7959.101. GENERAL POWERS AND DUTIES. The district has
9790 the powers and duties necessary to accomplish the purposes for
9891 which the district is created.
9992 Sec. 7959.102. MUNICIPAL UTILITY DISTRICT POWERS AND
10093 DUTIES. The district has the powers and duties provided by the
10194 general law of this state, including Chapters 49 and 54, Water Code,
10295 applicable to municipal utility districts created under Section 59,
10396 Article XVI, Texas Constitution.
10497 Sec. 7959.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10598 52, Article III, Texas Constitution, the district may design,
10699 acquire, construct, finance, issue bonds for, improve, operate,
107100 maintain, and convey to this state, a county, or a municipality for
108101 operation and maintenance macadamized, graveled, or paved roads, or
109102 improvements, including storm drainage, in aid of those roads.
110103 Sec. 7959.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
111104 project must meet all applicable construction standards, zoning and
112105 subdivision requirements, and regulations of each municipality in
113106 whose corporate limits or extraterritorial jurisdiction the road
114107 project is located.
115108 (b) If a road project is not located in the corporate limits
116109 or extraterritorial jurisdiction of a municipality, the road
117110 project must meet all applicable construction standards,
118111 subdivision requirements, and regulations of each county in which
119112 the road project is located.
120113 (c) If the state will maintain and operate the road, the
121114 Texas Transportation Commission must approve the plans and
122115 specifications of the road project.
123116 (d) The district shall convey the public roads constructed
124117 by or on behalf of the district under Section 7959.103 to Williamson
125118 County for ownership, operation, and maintenance by the county.
126119 After the 12th anniversary of the date the county accepts
127120 conveyance of the roads, the district shall maintain the public
128121 roads located in the district, except that the county shall
129122 maintain the east-west arterial roadway located in the district
130123 north of the San Gabriel River and south of State Highway 29. The
131124 district's obligation to maintain the public roads located in the
132125 district ceases if all of the territory of the district is annexed
133126 by a municipality.
134127 Sec. 7959.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
135128 OR RESOLUTION. The district shall comply with all applicable
136129 requirements of any ordinance or resolution that is adopted under
137130 Section 54.016 or 54.0165, Water Code, and that consents to the
138131 creation of the district or to the inclusion of land in the
139132 district.
140133 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
141134 Sec. 7959.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
142135 district may issue, without an election, bonds and other
143136 obligations secured by:
144137 (1) revenue other than ad valorem taxes; or
145138 (2) contract payments described by Section 7959.153.
146139 (b) The district must hold an election in the manner
147140 provided by Chapters 49 and 54, Water Code, to obtain voter approval
148141 before the district may impose an ad valorem tax or issue bonds
149142 payable from ad valorem taxes.
150143 (c) The district may not issue bonds payable from ad valorem
151144 taxes to finance a road project unless the issuance is approved by a
152145 vote of a two-thirds majority of the district voters voting at an
153146 election held for that purpose.
154147 Sec. 7959.152. OPERATION AND MAINTENANCE TAX. (a) If
155148 authorized at an election held under Section 7959.151, the district
156149 may impose an operation and maintenance tax on taxable property in
157150 the district in accordance with Section 49.107, Water Code.
158151 (b) The board shall determine the tax rate. The rate may not
159152 exceed the rate approved at the election.
160153 Sec. 7959.153. CONTRACT TAXES. (a) In accordance with
161154 Section 49.108, Water Code, the district may impose a tax other than
162155 an operation and maintenance tax and use the revenue derived from
163156 the tax to make payments under a contract after the provisions of
164157 the contract have been approved by a majority of the district voters
165158 voting at an election held for that purpose.
166159 (b) A contract approved by the district voters may contain a
167160 provision stating that the contract may be modified or amended by
168161 the board without further voter approval.
169162 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
170163 Sec. 7959.201. AUTHORITY TO ISSUE BONDS AND OTHER
171164 OBLIGATIONS. The district may issue bonds or other obligations
172165 payable wholly or partly from ad valorem taxes, impact fees,
173166 revenue, contract payments, grants, or other district money, or any
174167 combination of those sources, to pay for any authorized district
175168 purpose.
176169 Sec. 7959.202. TAXES FOR BONDS. At the time the district
177170 issues bonds payable wholly or partly from ad valorem taxes, the
178171 board shall provide for the annual imposition of a continuing
179172 direct ad valorem tax, without limit as to rate or amount, while all
180173 or part of the bonds are outstanding as required and in the manner
181174 provided by Sections 54.601 and 54.602, Water Code.
182175 Sec. 7959.203. BONDS FOR ROAD PROJECTS. At the time of
183176 issuance, the total principal amount of bonds or other obligations
184177 issued or incurred to finance road projects and payable from ad
185178 valorem taxes may not exceed one-fourth of the assessed value of the
186179 real property in the district.
187180 SECTION 2. The Williamson County Municipal Utility District
188181 No. 33 initially includes all the territory contained in the
189182 following area:

191184 BEING 103.78 ACRES OF LAND OUT OF THE HENRY GARMES SURVEY,
192185 ABSTRACT NO. 269, IN WILLIAMSON COUNTY, TEXAS, AND BEING COMPRISED
193186 OF TWO TRACTS: TRACT ONE BEING ALL OF A 25.32 ACRE TRACT, AND TRACT
194187 TWO BEING A PORTION OF A 217.19 ACRE TRACT, BOTH CONVEYED TO LANCE

506499 SECTION 3. (a) The legal notice of the intention to
507500 introduce this Act, setting forth the general substance of this
508501 Act, has been published as provided by law, and the notice and a
509502 copy of this Act have been furnished to all persons, agencies,
510503 officials, or entities to which they are required to be furnished
511504 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
512505 Government Code.
513506 (b) The governor, one of the required recipients, has
514507 submitted the notice and Act to the Texas Commission on
515508 Environmental Quality.
516509 (c) The Texas Commission on Environmental Quality has filed
517510 its recommendations relating to this Act with the governor, the
518511 lieutenant governor, and the speaker of the house of
519512 representatives within the required time.
520513 (d) All requirements of the constitution and laws of this
521514 state and the rules and procedures of the legislature with respect
522515 to the notice, introduction, and passage of this Act are fulfilled
523516 and accomplished.
524517 SECTION 4. (a) If this Act does not receive a two-thirds
525518 vote of all the members elected to each house, Subchapter C, Chapter
526519 7959, Special District Local Laws Code, as added by Section 1 of
527520 this Act, is amended by adding Section 7959.106 to read as follows:
528521 Sec. 7959.106. NO EMINENT DOMAIN POWER. The district may
529522 not exercise the power of eminent domain.
530523 (b) This section is not intended to be an expression of a
531524 legislative interpretation of the requirements of Section 17(c),
532525 Article I, Texas Constitution.
533526 SECTION 5. This Act takes effect immediately if it receives
534527 a vote of two-thirds of all the members elected to each house, as
535528 provided by Section 39, Article III, Texas Constitution. If this
536529 Act does not receive the vote necessary for immediate effect, this
537530 Act takes effect September 1, 2015.
