88 AN ACT
99 relating to the titling, registration, and operation of an
1010 autocycle; clarifying the vehicles that may be operated under
1111 certain licenses; amending provisions subject to a criminal
1212 penalty.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter A, Chapter 501, Transportation Code,
1515 is amended by adding Section 501.008 to read as follows:
1616 Sec. 501.008. TITLE FOR AUTOCYCLE. (a) In this section,
1717 "autocycle" means a motor vehicle, other than a tractor, that is:
1818 (1) designed to have when propelled not more than
1919 three wheels on the ground;
2020 (2) equipped with a steering wheel;
2121 (3) equipped with seating that does not require the
2222 operator to straddle or sit astride the seat; and
2323 (4) manufactured and certified to comply with federal
2424 safety requirements for a motorcycle.
2525 (b) For purposes of issuing a title under this chapter, an
2626 autocycle is considered to be a motorcycle.
2727 SECTION 2. Subchapter A, Chapter 502, Transportation Code,
2828 is amended by adding Section 502.004 to read as follows:
2929 Sec. 502.004. REGISTRATION OF AUTOCYCLE. (a) In this
3030 section, "autocycle" means a motor vehicle, other than a tractor,
3131 that is:
3232 (1) designed to have when propelled not more than
3333 three wheels on the ground;
3434 (2) equipped with a steering wheel;
3535 (3) equipped with seating that does not require the
3636 operator to straddle or sit astride the seat; and
3737 (4) manufactured and certified to comply with federal
3838 safety requirements for a motorcycle.
3939 (b) For purposes of registering a vehicle under this
4040 chapter, an autocycle is considered to be a motorcycle.
4141 SECTION 3. Section 521.084, Transportation Code, is amended
4242 to read as follows:
4343 Sec. 521.084. CLASS M LICENSE. A Class M driver's license
4444 authorizes the holder of the license to operate a motorcycle or
4545 moped as defined by Section 541.201.
4646 SECTION 4. Section 521.085(b), Transportation Code, is
4747 amended to read as follows:
4848 (b) Subsection (a) does not prohibit a license holder from
4949 operating a lesser type of vehicle that is a motorcycle described by
5050 Section 521.001(a)(6-a) or an autocycle as defined by Section
5151 501.008.
5252 SECTION 5. Section 545.416, Transportation Code, is amended
5353 by adding Subsection (f) to read as follows:
5454 (f) For purposes of Subsections (c) and (d), an autocycle as
5555 defined by Section 501.008 is considered to be a motorcycle.
5656 SECTION 6. Section 547.617, Transportation Code, is amended
5757 to read as follows:
5858 Sec. 547.617. MOTORCYCLE FOOTRESTS AND HANDHOLDS REQUIRED.
5959 (a) A motorcycle that is designed to carry more than one person
6060 must be equipped with footrests and handholds for use by the
6161 passenger.
6262 (b) This section does not apply to an autocycle as defined
6363 by Section 501.008 or a motorcycle as defined by Section
6464 521.001(a)(6-a).
6565 SECTION 7. Chapter 661, Transportation Code, is amended by
6666 adding Section 661.0015 to read as follows:
6767 Sec. 661.0015. PROTECTIVE HEADGEAR FOR AUTOCYCLE. (a) In
6868 this section, "autocycle" means a motor vehicle, other than a
6969 tractor, that is:
7070 (1) designed to have when propelled not more than
7171 three wheels on the ground;
7272 (2) equipped with a steering wheel;
7373 (3) equipped with seating that does not require the
7474 operator to straddle or sit astride the seat; and
7575 (4) manufactured and certified to comply with federal
7676 safety requirements for a motorcycle.
7777 (b) For purposes of this chapter, an autocycle is considered
7878 to be a motorcycle.
7979 SECTION 8. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2015.
