14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 9 | | SECTION 1. Section 28.002(d), Education Code, is amended to |
---|
16 | 10 | | read as follows: |
---|
17 | 11 | | (d) The physical education curriculum required under |
---|
18 | 12 | | Subsection (a)(2)(C) must be sequential, developmentally |
---|
19 | 13 | | appropriate, and designed, implemented, and evaluated to enable |
---|
20 | 14 | | students to develop the motor, self-management, and other skills, |
---|
21 | 15 | | knowledge, attitudes, and confidence necessary to participate in |
---|
22 | 16 | | physical activity throughout life. Each school district shall |
---|
23 | 17 | | establish specific objectives and goals the district intends to |
---|
24 | 18 | | accomplish through the physical education curriculum. In |
---|
25 | 19 | | identifying the essential knowledge and skills of physical |
---|
26 | 20 | | education, the State Board of Education shall ensure that the |
---|
27 | 21 | | curriculum: |
---|
28 | 22 | | (1) emphasizes the knowledge and skills capable of |
---|
29 | 23 | | being used during a lifetime of regular physical activity; |
---|
30 | 24 | | (2) is consistent with national physical education |
---|
31 | 25 | | standards for: |
---|
32 | 26 | | (A) the information that students should learn |
---|
33 | 27 | | about physical activity; and |
---|
34 | 28 | | (B) the physical activities that students should |
---|
35 | 29 | | be able to perform; |
---|
36 | 30 | | (3) requires that, on a weekly basis, at least 50 |
---|
37 | 31 | | percent of the physical education class be used for actual student |
---|
38 | 32 | | physical activity and that the activity be, to the extent |
---|
39 | 33 | | practicable, at a moderate or vigorous level; |
---|
40 | 34 | | (4) offers students an opportunity to choose among |
---|
41 | 35 | | many types of physical activity in which to participate; |
---|
42 | 36 | | (5) offers students both cooperative and competitive |
---|
43 | 37 | | games; |
---|
44 | 38 | | (6) meets the needs of students of all physical |
---|
45 | 39 | | ability levels, including students who have a [disability,] chronic |
---|
46 | 40 | | health problem, disability, including a student who is a person |
---|
47 | 41 | | with a disability described under Section 29.003(b) or criteria |
---|
48 | 42 | | developed by the agency in accordance with that section, or other |
---|
49 | 43 | | special need that precludes the student from participating in |
---|
50 | 44 | | regular physical education instruction but who might be able to |
---|
51 | 45 | | participate in physical education that is suitably adapted and, if |
---|
52 | 46 | | applicable, included in the student's individualized education |
---|
53 | 47 | | program; |
---|
54 | 48 | | (7) takes into account the effect that gender and |
---|
55 | 49 | | cultural differences might have on the degree of student interest |
---|
56 | 50 | | in physical activity or on the types of physical activity in which a |
---|
57 | 51 | | student is interested; |
---|
58 | 52 | | (8) teaches self-management and movement skills; |
---|
59 | 53 | | (9) teaches cooperation, fair play, and responsible |
---|
60 | 54 | | participation in physical activity; |
---|
61 | 55 | | (10) promotes student participation in physical |
---|
62 | 56 | | activity outside of school; and |
---|
63 | 57 | | (11) allows physical education classes to be an |
---|
64 | 58 | | enjoyable experience for students. |
---|
65 | 59 | | SECTION 2. This Act applies beginning with the 2015-2016 |
---|
66 | 60 | | school year. |
---|
67 | 61 | | SECTION 3. This Act takes effect immediately if it receives |
---|
68 | 62 | | a vote of two-thirds of all the members elected to each house, as |
---|
69 | 63 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
70 | 64 | | Act does not receive the vote necessary for immediate effect, this |
---|
71 | 65 | | Act takes effect September 1, 2015. |
