99 relating to the Texas emissions reduction plan, including the use
1010 of money in the Texas emissions reduction plan fund for rail
1111 projects.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 386.002, Health and Safety Code, is
1414 amended to read as follows:
1515 Sec. 386.002. EXPIRATION. This chapter expires August 31,
1616 2023 [2019].
1717 SECTION 2. Subchapter F, Chapter 386, Health and Safety
1818 Code, is amended by adding Section 386.253 to read as follows:
1919 Sec. 386.253. RAIL PROJECTS. A rail project, including a
2020 rail relocation and improvement project, that meets the criteria of
2121 a program established under this chapter is eligible to receive a
2222 grant or other funding from the Texas emissions reduction plan
2323 fund.
2424 SECTION 3. Sections 501.138(b-2) and (b-3), Transportation
2525 Code, are amended to read as follows:
2626 (b-2) The comptroller shall establish a record of the amount
2727 of the fees deposited to the credit of the Texas Mobility Fund under
2828 Subsection (b-1). On or before the fifth workday of each month,
2929 the Texas Department of Transportation shall remit to the
3030 comptroller for deposit to the credit of the Texas emissions
3131 reduction plan fund an amount of money equal to the amount of the
3232 fees deposited by the comptroller to the credit of the Texas
3333 Mobility Fund under Subsection (b-1) in the preceding month. The
3434 Texas Department of Transportation shall use for remittance to the
3535 comptroller as required by this subsection money in the state
3636 highway fund that is not required to be used for a purpose specified
3737 by Section 7-a, Article VIII, Texas Constitution, and may not use
3838 for that remittance money received by this state under the
3939 congestion mitigation and air quality improvement program
4040 established under 23 U.S.C. Section 149. A rail project, including
4141 a rail relocation and improvement project, that meets the criteria
4242 of a program established under the Texas emissions reduction plan
4343 is eligible to receive a grant or other funding from the Texas
4444 emissions reduction plan fund out of money deposited to the fund
4545 under this subsection.
4646 (b-3) This subsection and Subsection (b-2) expire August
4747 31, 2023 [2019].
4848 SECTION 4. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2015.
