| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 386.002, Health and Safety Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | Sec. 386.002. EXPIRATION. This chapter expires August 31, |
|---|
| 16 | 16 | | 2023 [2019]. |
|---|
| 17 | 17 | | SECTION 2. Subchapter F, Chapter 386, Health and Safety |
|---|
| 18 | 18 | | Code, is amended by adding Section 386.253 to read as follows: |
|---|
| 19 | 19 | | Sec. 386.253. RAIL PROJECTS. A rail project, including a |
|---|
| 20 | 20 | | rail relocation and improvement project, that meets the criteria of |
|---|
| 21 | 21 | | a program established under this chapter is eligible to receive a |
|---|
| 22 | 22 | | grant or other funding from the Texas emissions reduction plan |
|---|
| 23 | 23 | | fund. |
|---|
| 24 | 24 | | SECTION 3. Sections 501.138(b-2) and (b-3), Transportation |
|---|
| 25 | 25 | | Code, are amended to read as follows: |
|---|
| 26 | 26 | | (b-2) The comptroller shall establish a record of the amount |
|---|
| 27 | 27 | | of the fees deposited to the credit of the Texas Mobility Fund under |
|---|
| 28 | 28 | | Subsection (b-1). On or before the fifth workday of each month, |
|---|
| 29 | 29 | | the Texas Department of Transportation shall remit to the |
|---|
| 30 | 30 | | comptroller for deposit to the credit of the Texas emissions |
|---|
| 31 | 31 | | reduction plan fund an amount of money equal to the amount of the |
|---|
| 32 | 32 | | fees deposited by the comptroller to the credit of the Texas |
|---|
| 33 | 33 | | Mobility Fund under Subsection (b-1) in the preceding month. The |
|---|
| 34 | 34 | | Texas Department of Transportation shall use for remittance to the |
|---|
| 35 | 35 | | comptroller as required by this subsection money in the state |
|---|
| 36 | 36 | | highway fund that is not required to be used for a purpose specified |
|---|
| 37 | 37 | | by Section 7-a, Article VIII, Texas Constitution, and may not use |
|---|
| 38 | 38 | | for that remittance money received by this state under the |
|---|
| 39 | 39 | | congestion mitigation and air quality improvement program |
|---|
| 40 | 40 | | established under 23 U.S.C. Section 149. A rail project, including |
|---|
| 41 | 41 | | a rail relocation and improvement project, that meets the criteria |
|---|
| 42 | 42 | | of a program established under the Texas emissions reduction plan |
|---|
| 43 | 43 | | is eligible to receive a grant or other funding from the Texas |
|---|
| 44 | 44 | | emissions reduction plan fund out of money deposited to the fund |
|---|
| 45 | 45 | | under this subsection. |
|---|
| 46 | 46 | | (b-3) This subsection and Subsection (b-2) expire August |
|---|
| 47 | 47 | | 31, 2023 [2019]. |
|---|
| 48 | 48 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2015. |
