66 AN ACT
77 relating to requiring candidates to pay a filing fee or submit a
88 petition in lieu of a filing fee to appear on the ballot for the
99 general election for state and county officers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 141, Election Code, is
1212 amended by adding Section 141.041 to read as follows:
1313 Sec. 141.041. FILING FEE OR PETITION TO APPEAR ON BALLOT FOR
1414 GENERAL ELECTION FOR STATE AND COUNTY OFFICERS. (a) In addition
1515 to any other requirements, to be eligible to be placed on the ballot
1616 for the general election for state and county officers, a candidate
1717 who is nominated by convention under Chapter 181 or 182 must:
1818 (1) pay a filing fee to the secretary of state for a
1919 statewide or district office or the county judge for a county or
2020 precinct office; or
2121 (2) submit to the secretary of state for a statewide or
2222 district office or the county judge for a county or precinct office
2323 a petition in lieu of a filing fee that satisfies the requirements
2424 prescribed by Subsection (e) and Section 141.062.
2525 (b) The amount of the filing fee is the amount prescribed by
2626 Section 172.024 for a candidate for nomination for the same office
2727 in a general primary election.
2828 (c) A filing fee received by the secretary of state shall be
2929 deposited in the state treasury to the credit of the general revenue
3030 fund.
3131 (d) A filing fee received by the county judge shall be
3232 deposited in the county treasury to the credit of the county general
3333 fund.
3434 (e) The minimum number of signatures that must appear on the
3535 petition authorized by Subsection (a) is the number prescribed by
3636 Section 172.025 to appear on a petition of a candidate for
3737 nomination for the same office in a general primary election.
3838 (f) The secretary of state shall adopt rules as necessary to
3939 implement this section.
4040 SECTION 2. This Act takes effect September 1, 2015.
