9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 17, Utilities Code, is | |
11 | 11 | amended by adding Section 17.010 to read as follows: | |
12 | 12 | Sec. 17.010. CUSTOMER PROTECTION; SMART THERMOSTATS. (a) | |
13 | 13 | The commission shall ensure that a retail electric provider or | |
14 | 14 | aggregator that offers to residential or small commercial customers | |
15 | 15 | a product or service related to smart thermostats provides to the | |
16 | 16 | customers in marketing communications and contract materials clear | |
17 | 17 | descriptions in plain language of the product or service, of the | |
18 | 18 | contract terms, and of customers' rights. | |
19 | 19 | (b) The commission shall adopt and enforce rules as | |
20 | 20 | necessary to implement this section. Rules adopted under this | |
21 | 21 | section must be at least as protective of customers' interests as | |
22 | 22 | general commission rules regarding marketing of and contracting for | |
23 | 23 | electric services for residential and small commercial customers. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2015. |
