66 AN ACT
77 relating to prohibiting the purchase of energy drinks under the
88 supplemental nutrition assistance program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1111 is amended by adding Section 33.035 to read as follows:
1212 Sec. 33.035. PURCHASE OF ENERGY DRINKS PROHIBITED UNDER
1313 SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM. (a) In this section,
1414 "energy drink" means a beverage containing at least 65 milligrams
1515 of caffeine per 8 fluid ounces that is advertised as being
1616 specifically designed to provide metabolic stimulation or an
1717 increase to the consumer's mental or physical energy. The term does
1818 not include coffee or any substantially coffee-based beverage.
1919 (b) A recipient may not use supplemental nutrition
2020 assistance benefits to purchase an energy drink.
2121 (c) The department shall conduct a public outreach campaign
2222 to promote awareness of the prohibition under this section.
2323 SECTION 2. If before implementing any provision of this Act
2424 a state agency determines that authorization from a federal agency
2525 is necessary for implementation of that provision, the agency
2626 affected by the provision shall request the authorization and may
2727 delay implementing that provision until the authorization is
2828 granted.
2929 SECTION 3. This Act takes effect September 1, 2015.
