7 | 7 | | relating to limits on the size of certain classes in public schools. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Sections 25.112(a), (d), and (e), Education |
---|
10 | 10 | | Code, are amended to read as follows: |
---|
11 | 11 | | (a) Except as otherwise authorized by this section, a school |
---|
12 | 12 | | district may not enroll more than 22 students in a kindergarten, |
---|
13 | 13 | | first, second, third, or fourth grade class or 28 students in a |
---|
14 | 14 | | fifth, sixth, seventh, or eighth grade class. A limit imposed by |
---|
15 | 15 | | this subsection [That limitation] does not apply during: |
---|
16 | 16 | | (1) any 12-week period of the school year selected by |
---|
17 | 17 | | the district, in the case of a district whose average daily |
---|
18 | 18 | | attendance is adjusted under Section 42.005(c); or |
---|
19 | 19 | | (2) the last 12 weeks of any school year in the case of |
---|
20 | 20 | | any other district. |
---|
21 | 21 | | (d) On application of a school district, the commissioner |
---|
22 | 22 | | may except the district from a [the] limit imposed by [in] |
---|
23 | 23 | | Subsection (a) if the commissioner finds the limit works an undue |
---|
24 | 24 | | hardship on the district. An exception expires at the end of the |
---|
25 | 25 | | school year for which it is granted. |
---|
26 | 26 | | (e) A school district seeking an exception under Subsection |
---|
27 | 27 | | (d) shall notify the commissioner and apply for the exception not |
---|
28 | 28 | | later than the later of: |
---|
29 | 29 | | (1) October 1; or |
---|
30 | 30 | | (2) the 30th day after the first school day the |
---|
31 | 31 | | district exceeds a [the] limit imposed by [in] Subsection (a). |
---|
32 | 32 | | SECTION 2. Section 25.113(a), Education Code, is amended to |
---|
33 | 33 | | read as follows: |
---|
34 | 34 | | (a) A campus or district that is granted an exception under |
---|
35 | 35 | | Section 25.112(d) from class size limits shall provide written |
---|
36 | 36 | | notice of the exception to the parent of or person standing in |
---|
37 | 37 | | parental relation to each student affected by the exception. The |
---|
38 | 38 | | notice must be in conspicuous bold or underlined print and: |
---|
39 | 39 | | (1) specify the class for which an exception from a |
---|
40 | 40 | | [the] limit imposed by Section 25.112(a) was granted; |
---|
41 | 41 | | (2) state the number of children in the class for which |
---|
42 | 42 | | the exception was granted; and |
---|
43 | 43 | | (3) be included in a regular mailing or other |
---|
44 | 44 | | communication from the campus or district, such as information sent |
---|
45 | 45 | | home with students. |
---|
46 | 46 | | SECTION 3. Subchapter E, Chapter 42, Education Code, is |
---|
47 | 47 | | amended by adding Section 42.25191 to read as follows: |
---|
48 | 48 | | Sec. 42.25191. ADDITIONAL STATE AID FOR CERTAIN LIMITS ON |
---|
49 | 49 | | CLASS SIZES. (a) For each school year, from funds that may be used |
---|
50 | 50 | | for the purpose, a school district is entitled to state aid in an |
---|
51 | 51 | | amount, as determined by the commissioner, sufficient to assist the |
---|
52 | 52 | | district in complying with the limit on the number of students who |
---|
53 | 53 | | may be enrolled in a fifth, sixth, seventh, or eighth grade class |
---|
54 | 54 | | under Section 25.112. |
---|
55 | 55 | | (b) The amount of state aid to which a school district is |
---|
56 | 56 | | entitled under this section is in addition to the amount of revenue |
---|
57 | 57 | | to which the district is entitled under Section 42.2516(b). This |
---|
58 | 58 | | subsection expires September 1, 2017. |
---|
59 | 59 | | (c) The commissioner shall adopt rules as necessary to |
---|
60 | 60 | | administer this section. |
---|
61 | 61 | | SECTION 4. This Act applies beginning with the 2015-2016 |
---|
62 | 62 | | school year. |
---|
63 | 63 | | SECTION 5. This Act takes effect immediately if it receives |
---|
64 | 64 | | a vote of two-thirds of all the members elected to each house, as |
---|
65 | 65 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
66 | 66 | | Act does not receive the vote necessary for immediate effect, this |
---|
67 | 67 | | Act takes effect September 1, 2015. |
