66 AN ACT
77 relating to limits on the size of certain classes in public schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 25.112(a), (d), and (e), Education
1010 Code, are amended to read as follows:
1111 (a) Except as otherwise authorized by this section, a school
1212 district may not enroll more than 22 students in a kindergarten,
1313 first, second, third, or fourth grade class or 28 students in a
1414 fifth, sixth, seventh, or eighth grade class. A limit imposed by
1515 this subsection [That limitation] does not apply during:
1616 (1) any 12-week period of the school year selected by
1717 the district, in the case of a district whose average daily
1818 attendance is adjusted under Section 42.005(c); or
1919 (2) the last 12 weeks of any school year in the case of
2020 any other district.
2121 (d) On application of a school district, the commissioner
2222 may except the district from a [the] limit imposed by [in]
2323 Subsection (a) if the commissioner finds the limit works an undue
2424 hardship on the district. An exception expires at the end of the
2525 school year for which it is granted.
2626 (e) A school district seeking an exception under Subsection
2727 (d) shall notify the commissioner and apply for the exception not
2828 later than the later of:
2929 (1) October 1; or
3030 (2) the 30th day after the first school day the
3131 district exceeds a [the] limit imposed by [in] Subsection (a).
3232 SECTION 2. Section 25.113(a), Education Code, is amended to
3333 read as follows:
3434 (a) A campus or district that is granted an exception under
3535 Section 25.112(d) from class size limits shall provide written
3636 notice of the exception to the parent of or person standing in
3737 parental relation to each student affected by the exception. The
3838 notice must be in conspicuous bold or underlined print and:
3939 (1) specify the class for which an exception from a
4040 [the] limit imposed by Section 25.112(a) was granted;
4141 (2) state the number of children in the class for which
4242 the exception was granted; and
4343 (3) be included in a regular mailing or other
4444 communication from the campus or district, such as information sent
4545 home with students.
4646 SECTION 3. Subchapter E, Chapter 42, Education Code, is
4747 amended by adding Section 42.25191 to read as follows:
4848 Sec. 42.25191. ADDITIONAL STATE AID FOR CERTAIN LIMITS ON
4949 CLASS SIZES. (a) For each school year, from funds that may be used
5050 for the purpose, a school district is entitled to state aid in an
5151 amount, as determined by the commissioner, sufficient to assist the
5252 district in complying with the limit on the number of students who
5353 may be enrolled in a fifth, sixth, seventh, or eighth grade class
5454 under Section 25.112.
5555 (b) The amount of state aid to which a school district is
5656 entitled under this section is in addition to the amount of revenue
5757 to which the district is entitled under Section 42.2516(b). This
5858 subsection expires September 1, 2017.
5959 (c) The commissioner shall adopt rules as necessary to
6060 administer this section.
6161 SECTION 4. This Act applies beginning with the 2015-2016
6262 school year.
6363 SECTION 5. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2015.
