76 relating to venue for the offense of failure to attend school.
87 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9- SECTION 1. Section 25.094(b), Education Code, is amended to

10+ (b) The attendance officer or other appropriate school
11+ official shall file a complaint against the parent in:
12+ (1) the constitutional county court of the county in
13+ which the parent resides or in which the school is located, if the
14+ county has a population of 1.75 million or more;
15+ (2) a justice court designated to hear cases arising
16+ under this section [of any precinct] in the county in which the
17+ parent resides or in which the school is located, or if no justice
18+ court is designated, a justice court of any precinct in the county
19+ in which the parent resides or in which the school is located; or
20+ (3) a municipal court of the municipality in which the
21+ parent resides or in which the school is located.
22+ SECTION 2. Section 25.094(b), Education Code, is amended to

1124 (b) An offense under this section may be prosecuted in:
1225 (1) the constitutional county court of the county in
1326 which the individual resides or in which the school is located, if
1427 the county has a population of 1.75 million or more;
1528 (2) a justice court designated to hear cases arising
1629 under this section [of any precinct] in the county in which the
1730 individual resides or in which the school is located, or if no
1831 justice court is designated, a justice court of any precinct in the
1932 county in which the individual resides or in which the school is
2033 located; or
2134 (3) a municipal court in the municipality in which the
2235 individual resides or in which the school is located.
23- SECTION 2. The changes in law made by this Act to Section
24- 25.094, Education Code, apply only to an offense committed on or
25- after the effective date of this Act. For purposes of this section,
26- an offense is committed before the effective date of this Act if any
27- element of the offense occurs before that date. An offense
28- committed before the effective date of this Act is covered by the
29- law in effect immediately before the effective date of this Act, and
30- the former law is continued in effect for that purpose.
31- SECTION 3. This Act takes effect September 1, 2015.
36+ SECTION 3. The changes in law made by this Act to Sections
37+ 25.093 and 25.094, Education Code, apply only to an offense
38+ committed on or after the effective date of this Act. For purposes
39+ of this section, an offense is committed before the effective date
40+ of this Act if any element of the offense occurs before that date.
41+ An offense committed before the effective date of this Act is
42+ covered by the law in effect immediately before the effective date
43+ of this Act, and the former law is continued in effect for that
44+ purpose.
45+ SECTION 4. This Act takes effect September 1, 2015.
