55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to venue for the offense of a parent contributing to a
88 child's failure to attend school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.093(b), Education Code, is amended to
1111 read as follows:
1212 (b) The attendance officer or other appropriate school
1313 official shall file a complaint against the parent in:
1414 (1) the constitutional county court of the county in
1515 which the parent resides or in which the school is located, if the
1616 county has a population of 1.75 million or more;
1717 (2) a justice court designated to hear cases arising
1818 under this section [of any precinct] in the county in which the
1919 parent resides or in which the school is located, or if no justice
2020 court is designated, a justice court of any precinct in the county
2121 in which the parent resides or in which the school is located; or
2222 (3) a municipal court of the municipality in which the
2323 parent resides or in which the school is located.
2424 SECTION 2. The changes in law made by this Act to Section
2525 25.093, Education Code, apply only to an offense committed on or
2626 after the effective date of this Act. For purposes of this section,
2727 an offense is committed before the effective date of this Act if any
2828 element of the offense occurs before that date. An offense
2929 committed before the effective date of this Act is covered by the
3030 law in effect immediately before the effective date of this Act, and
3131 the former law is continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2015.
