| 7 | 7 | | relating to venue for the offense of a parent contributing to a |

| 8 | 8 | | child's failure to attend school. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.093(b), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (b) The attendance officer or other appropriate school |
|---|
| 13 | 13 | | official shall file a complaint against the parent in: |
|---|
| 14 | 14 | | (1) the constitutional county court of the county in |
|---|
| 15 | 15 | | which the parent resides or in which the school is located, if the |
|---|
| 16 | 16 | | county has a population of 1.75 million or more; |
|---|
| 17 | 17 | | (2) a justice court designated to hear cases arising |
|---|
| 18 | 18 | | under this section [of any precinct] in the county in which the |
|---|
| 19 | 19 | | parent resides or in which the school is located, or if no justice |
|---|
| 20 | 20 | | court is designated, a justice court of any precinct in the county |
|---|
| 21 | 21 | | in which the parent resides or in which the school is located; or |
|---|
| 22 | 22 | | (3) a municipal court of the municipality in which the |
|---|
| 23 | 23 | | parent resides or in which the school is located. |

| 24 | 24 | | SECTION 2. The changes in law made by this Act to Section |
|---|
| 25 | 25 | | 25.093, Education Code, apply only to an offense committed on or |
|---|
| 26 | 26 | | after the effective date of this Act. For purposes of this section, |
|---|
| 27 | 27 | | an offense is committed before the effective date of this Act if any |
|---|
| 28 | 28 | | element of the offense occurs before that date. An offense |
|---|
| 29 | 29 | | committed before the effective date of this Act is covered by the |
|---|
| 30 | 30 | | law in effect immediately before the effective date of this Act, and |
|---|
| 31 | 31 | | the former law is continued in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2015. |
