55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the offense of manslaughter.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 19.04(b), Penal Code, is amended to read
1010 as follows:
1111 (b) An offense under this section is a felony of the second
1212 degree, except that an offense is a felony of the first degree if:
1313 (1) the actor delivered a controlled substance to the
1414 individual in violation of Chapter 481, Health and Safety Code;
1515 (2) the individual consumed the controlled substance
1616 without altering the substance; and
1717 (3) the individual's death resulted from the
1818 consumption of the controlled substance.
1919 SECTION 2. The change in law made by this Act applies only
2020 to an offense committed on or after the effective date of this Act.
2121 An offense committed before the effective date of this Act is
2222 governed by the law in effect on the date the offense was committed,
2323 and the former law is continued in effect for that purpose. For
2424 purposes of this section, an offense was committed before the
2525 effective date of this Act if any element of the offense was
2626 committed before that date.
2727 SECTION 3. This Act takes effect September 1, 2015.
