55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to payment by a school district of the costs of
88 developmental coursework provided by an institution of higher
99 education under the success initiative.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 11, Education Code, is
1212 amended by adding Section 11.181 to read as follows:
1313 Sec. 11.181. SCHOOL DISTRICT RESPONSIBILITY FOR CERTAIN
1414 DEVELOPMENTAL COURSEWORK COSTS. (a) The commissioner shall assign
1515 to a school district from which a student who is required under
1616 Section 51.3062 to enroll in developmental coursework graduates all
1717 of the costs of the developmental coursework provided by an
1818 institution of higher education. The commissioner shall assign the
1919 costs as provided by the rules adopted under this section and
2020 Section 51.3062.
2121 (b) The commissioner, in cooperation with the Texas Higher
2222 Education Coordinating Board, shall adopt rules to facilitate
2323 assigning costs to school districts for developmental coursework as
2424 provided under this section. The rules shall be designed to ensure
2525 fairness, consistency, and fundamental due process.
2626 SECTION 2. Section 51.3062, Education Code, is amended by
2727 adding Subsection (i-6) to read as follows:
2828 (i-6) The board, in cooperation with the commissioner of
2929 education, shall adopt rules to facilitate assigning costs to
3030 school districts for developmental coursework as provided under
3131 Section 11.181. The rules shall be designed to ensure fairness,
3232 consistency, and fundamental due process.
3333 SECTION 3. This Act applies beginning with courses taken in
3434 the 2015 fall semester.
3535 SECTION 4. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2015.
