| 9 | 9 | | education under the success initiative. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 11, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 11.181 to read as follows: |
|---|
| 13 | 13 | | Sec. 11.181. SCHOOL DISTRICT RESPONSIBILITY FOR CERTAIN |
|---|
| 14 | 14 | | DEVELOPMENTAL COURSEWORK COSTS. (a) The commissioner shall assign |
|---|
| 15 | 15 | | to a school district from which a student who is required under |
|---|
| 16 | 16 | | Section 51.3062 to enroll in developmental coursework graduates all |
|---|
| 17 | 17 | | of the costs of the developmental coursework provided by an |
|---|
| 18 | 18 | | institution of higher education. The commissioner shall assign the |
|---|
| 19 | 19 | | costs as provided by the rules adopted under this section and |
|---|
| 20 | 20 | | Section 51.3062. |
|---|
| 21 | 21 | | (b) The commissioner, in cooperation with the Texas Higher |
|---|
| 22 | 22 | | Education Coordinating Board, shall adopt rules to facilitate |
|---|
| 23 | 23 | | assigning costs to school districts for developmental coursework as |
|---|
| 24 | 24 | | provided under this section. The rules shall be designed to ensure |
|---|
| 25 | 25 | | fairness, consistency, and fundamental due process. |
|---|
| 26 | 26 | | SECTION 2. Section 51.3062, Education Code, is amended by |
|---|
| 27 | 27 | | adding Subsection (i-6) to read as follows: |
|---|
| 28 | 28 | | (i-6) The board, in cooperation with the commissioner of |
|---|
| 29 | 29 | | education, shall adopt rules to facilitate assigning costs to |
|---|
| 30 | 30 | | school districts for developmental coursework as provided under |
|---|
| 31 | 31 | | Section 11.181. The rules shall be designed to ensure fairness, |
|---|
| 32 | 32 | | consistency, and fundamental due process. |
|---|
| 33 | 33 | | SECTION 3. This Act applies beginning with courses taken in |
|---|
| 34 | 34 | | the 2015 fall semester. |
|---|
| 35 | 35 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2015. |
