55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a defense to prosecution for the offense of possessing
88 or carrying a firearm on the premises of a polling place.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.03, Penal Code, is amended by
1111 amending Subsection (f) and adding Subsection (j) to read as
1212 follows:
1313 (f) Except as provided by Subsection (j), it [It] is not a
1414 defense to prosecution under this section that the actor possessed
1515 a handgun and was licensed to carry a concealed handgun under
1616 Subchapter H, Chapter 411, Government Code.
1717 (j) It is a defense to prosecution under Subsection (a)(2)
1818 that the actor, while serving as an election judge or clerk at the
1919 polling place, possessed a concealed handgun that the actor was
2020 licensed to carry under Subchapter H, Chapter 411, Government Code.
2121 SECTION 2. The change in law made by this Act applies only
2222 to an offense committed on or after the effective date of this Act.
2323 An offense committed before the effective date of this Act is
2424 governed by the law in effect on the date the offense was committed,
2525 and the former law is continued in effect for that purpose. For
2626 purposes of this section, an offense was committed before the
2727 effective date of this Act if any element of the offense occurred
2828 before that date.
2929 SECTION 3. This Act takes effect September 1, 2015.
