66 AN ACT
77 relating to service retirement benefits payable by the Teacher
88 Retirement System of Texas to certain bus drivers who return to
99 work.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 824.602(a), Government Code, is amended
1212 to read as follows:
1313 (a) Subject to Section 825.506, the retirement system may
1414 not, under Section 824.601, withhold a monthly benefit payment if
1515 the retiree is employed in a Texas public educational institution:
1616 (1) as a substitute only with pay not more than the
1717 daily rate of substitute pay established by the employer and, if the
1818 retiree is a disability retiree, the employment has not exceeded a
1919 total of 90 days in the school year;
2020 (2) in a position, other than as a substitute, on no
2121 more than a one-half time basis for the month;
2222 (3) in one or more positions on as much as a full-time
2323 basis, if the retiree has been separated from service with all Texas
2424 public educational institutions for at least 12 full consecutive
2525 months after the retiree's effective date of retirement; [or]
2626 (4) in a position, other than as a substitute, on no
2727 more than a one-half time basis for no more than 90 days in the
2828 school year, if the retiree is a disability retiree; or
2929 (5) as a bus driver for a school district on as much as
3030 a full-time basis, if:
3131 (A) the retiree has retired under Section
3232 824.202(a), (a-1), or (a-2);
3333 (B) the retiree's primary employment is as a bus
3434 driver; and
3535 (C) for at least 12 full consecutive months after
3636 the retiree's effective date of retirement, the retiree has not
3737 worked as a bus driver with a school district on more than a
3838 one-half-time basis.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2015.
