55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the scheduling of the last day of school for students by
88 public school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 7.056(e), Education Code, is amended to
1111 read as follows:
1212 (e) Except as provided by Subsection (f), a school campus or
1313 district may not receive an exemption or waiver under this section
1414 from:
1515 (1) a prohibition on conduct that constitutes a
1616 criminal offense;
1717 (2) a requirement imposed by federal law or rule,
1818 including a requirement for special education or bilingual
1919 education programs; or
2020 (3) a requirement, restriction, or prohibition
2121 relating to:
2222 (A) essential knowledge or skills under Section
2323 28.002 or high school graduation requirements under Section 28.025;
2424 (B) public school accountability as provided by
2525 Subchapters B, C, D, E, and J, Chapter 39;
2626 (C) extracurricular activities under Section
2727 33.081 or participation in a University Interscholastic League
2828 area, regional, or state competition under Section 33.0812;
2929 (D) health and safety under Chapter 38;
3030 (E) purchasing under Subchapter B, Chapter 44;
3131 (F) elementary school class size limits, except
3232 as provided by Section 25.112;
3333 (G) removal of a disruptive student from the
3434 classroom under Subchapter A, Chapter 37;
3535 (H) at-risk programs under Subchapter C, Chapter
3636 29;
3737 (I) prekindergarten programs under Subchapter E,
3838 Chapter 29;
3939 (J) educator rights and benefits under
4040 Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter
4141 A, Chapter 22;
4242 (K) special education programs under Subchapter
4343 A, Chapter 29;
4444 (L) bilingual education programs under
4545 Subchapter B, Chapter 29; or
4646 (M) the requirements for the last [first] day of
4747 school [instruction] under Section 25.0812 [25.0811].
4848 SECTION 2. Subchapter C, Chapter 25, Education Code, is
4949 amended by adding Section 25.0812 to read as follows:
5050 Sec. 25.0812. LAST DAY OF SCHOOL. (a) Except as provided by
5151 Subsection (b), a school district may not schedule the last day of
5252 school for students for a school year after the Friday preceding
5353 Memorial Day.
5454 (b) A school district may schedule the last day of school
5555 for students for a school year after the Friday preceding Memorial
5656 Day if the district operates a year-round system under Section
5757 25.084.
5858 (c) Notwithstanding Subsection (a), a school district that
5959 does not offer each grade level from kindergarten through grade 12
6060 and whose prospective or former students generally attend school in
6161 another state for the grade levels the district does not offer may
6262 schedule the last day of school on any date permitted under
6363 Subsection (a) or the law of the other state.
6464 SECTION 3. Section 25.084(a), Education Code, is amended to
6565 read as follows:
6666 (a) A school district may operate its schools year-round on
6767 either a single-track or a multitrack calendar. If a school
6868 district adopts a year-round system, the district may modify:
6969 (1) the number of contract days of employees and the
7070 number of days of operation, including any time required for staff
7171 development, planning and preparation, and continuing education,
7272 otherwise required by law;
7373 (2) testing dates, data reporting, and related
7474 matters;
7575 (3) the date of the last [first] day of school for
7676 students for a [instruction of the] school year under Section
7777 25.0812 [25.0811] for a school that was operating year-round for
7878 the 2014-2015 [2000-2001] school year; and
7979 (4) a student's eligibility to participate in
8080 extracurricular activities when the student's calendar track is not
8181 in session.
8282 SECTION 4. Section 151.326(a), Tax Code, is amended to read
8383 as follows:
8484 (a) The sale of an article of clothing or footwear designed
8585 to be worn on or about the human body is exempted from the taxes
8686 imposed by this chapter if:
8787 (1) the sales price of the article is less than $100;
8888 and
8989 (2) the sale takes place during a period beginning at
9090 12:01 a.m. on the second Friday of August [before the 15th day
9191 preceding the uniform date prescribed by Section 25.0811(a),
9292 Education Code, without regard to any exception authorized by that
9393 section, before which a school district may not begin instruction
9494 for the school year,] and ending at 12 midnight on the following
9595 Sunday.
9696 SECTION 5. Section 25.0811, Education Code, is repealed.
9797 SECTION 6. This Act applies beginning with the 2016-2017
9898 school year.
9999 SECTION 7. This Act takes effect May 1, 2016.
