9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 7.056(e), Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (e) Except as provided by Subsection (f), a school campus or |
---|
13 | 13 | | district may not receive an exemption or waiver under this section |
---|
14 | 14 | | from: |
---|
15 | 15 | | (1) a prohibition on conduct that constitutes a |
---|
16 | 16 | | criminal offense; |
---|
17 | 17 | | (2) a requirement imposed by federal law or rule, |
---|
18 | 18 | | including a requirement for special education or bilingual |
---|
19 | 19 | | education programs; or |
---|
20 | 20 | | (3) a requirement, restriction, or prohibition |
---|
21 | 21 | | relating to: |
---|
22 | 22 | | (A) essential knowledge or skills under Section |
---|
23 | 23 | | 28.002 or high school graduation requirements under Section 28.025; |
---|
24 | 24 | | (B) public school accountability as provided by |
---|
25 | 25 | | Subchapters B, C, D, E, and J, Chapter 39; |
---|
26 | 26 | | (C) extracurricular activities under Section |
---|
27 | 27 | | 33.081 or participation in a University Interscholastic League |
---|
28 | 28 | | area, regional, or state competition under Section 33.0812; |
---|
29 | 29 | | (D) health and safety under Chapter 38; |
---|
30 | 30 | | (E) purchasing under Subchapter B, Chapter 44; |
---|
31 | 31 | | (F) elementary school class size limits, except |
---|
32 | 32 | | as provided by Section 25.112; |
---|
33 | 33 | | (G) removal of a disruptive student from the |

34 | 34 | | classroom under Subchapter A, Chapter 37; |

48 | 48 | | SECTION 2. Subchapter C, Chapter 25, Education Code, is |
---|
49 | 49 | | amended by adding Section 25.0812 to read as follows: |
---|
50 | 50 | | Sec. 25.0812. LAST DAY OF SCHOOL. (a) Except as provided by |
---|
51 | 51 | | Subsection (b), a school district may not schedule the last day of |
---|
52 | 52 | | school for students for a school year after the Friday preceding |
---|
53 | 53 | | Memorial Day. |
---|
54 | 54 | | (b) A school district may schedule the last day of school |
---|
55 | 55 | | for students for a school year after the Friday preceding Memorial |
---|
56 | 56 | | Day if the district operates a year-round system under Section |
---|
57 | 57 | | 25.084. |
---|
58 | 58 | | (c) Notwithstanding Subsection (a), a school district that |
---|
59 | 59 | | does not offer each grade level from kindergarten through grade 12 |
---|
60 | 60 | | and whose prospective or former students generally attend school in |
---|
61 | 61 | | another state for the grade levels the district does not offer may |
---|
62 | 62 | | schedule the last day of school on any date permitted under |
---|
63 | 63 | | Subsection (a) or the law of the other state. |
---|
64 | 64 | | SECTION 3. Section 25.084(a), Education Code, is amended to |
---|
65 | 65 | | read as follows: |
---|
66 | 66 | | (a) A school district may operate its schools year-round on |
---|
67 | 67 | | either a single-track or a multitrack calendar. If a school |
---|
68 | 68 | | district adopts a year-round system, the district may modify: |
---|
69 | 69 | | (1) the number of contract days of employees and the |
---|
70 | 70 | | number of days of operation, including any time required for staff |
---|
71 | 71 | | development, planning and preparation, and continuing education, |
---|
72 | 72 | | otherwise required by law; |
---|
73 | 73 | | (2) testing dates, data reporting, and related |
---|
74 | 74 | | matters; |
---|
75 | 75 | | (3) the date of the last [first] day of school for |
---|
76 | 76 | | students for a [instruction of the] school year under Section |
---|
77 | 77 | | 25.0812 [25.0811] for a school that was operating year-round for |
---|
78 | 78 | | the 2014-2015 [2000-2001] school year; and |
---|
79 | 79 | | (4) a student's eligibility to participate in |
---|
80 | 80 | | extracurricular activities when the student's calendar track is not |
---|
81 | 81 | | in session. |
---|
82 | 82 | | SECTION 4. Section 151.326(a), Tax Code, is amended to read |
---|
83 | 83 | | as follows: |
---|
84 | 84 | | (a) The sale of an article of clothing or footwear designed |
---|
85 | 85 | | to be worn on or about the human body is exempted from the taxes |
---|
86 | 86 | | imposed by this chapter if: |
---|
87 | 87 | | (1) the sales price of the article is less than $100; |
---|
88 | 88 | | and |
---|
89 | 89 | | (2) the sale takes place during a period beginning at |
---|
90 | 90 | | 12:01 a.m. on the second Friday of August [before the 15th day |
---|
91 | 91 | | preceding the uniform date prescribed by Section 25.0811(a), |
---|
92 | 92 | | Education Code, without regard to any exception authorized by that |
---|
93 | 93 | | section, before which a school district may not begin instruction |
---|
94 | 94 | | for the school year,] and ending at 12 midnight on the following |
---|
95 | 95 | | Sunday. |
---|
96 | 96 | | SECTION 5. Section 25.0811, Education Code, is repealed. |
---|
97 | 97 | | SECTION 6. This Act applies beginning with the 2016-2017 |
---|
98 | 98 | | school year. |
---|
99 | 99 | | SECTION 7. This Act takes effect May 1, 2016. |
