99 relating to electronic benefits transfer cards used for recipients
1010 of benefits under certain assistance programs.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1313 amended by adding Section 531.0911 to read as follows:
1414 Sec. 531.0911. PHOTOGRAPH ON CERTAIN ELECTRONIC BENEFITS
1515 TRANSFER CARDS. (a) In this section:
1616 (1) "Financial assistance program" means the
1717 financial assistance program established under Chapter 31, Human
1818 Resources Code.
1919 (2) "Recipient" means a person who receives benefits
2020 under the financial assistance program or the supplemental
2121 nutrition assistance program.
2222 (3) "Supplemental nutrition assistance program" has
2323 the meaning assigned by Section 33.0005, Human Resources Code.
2424 (b) The commission shall ensure that each electronic
2525 benefits transfer card used by a recipient, or other person
2626 authorized on the recipient's account, for purposes of receiving
2727 benefits under the financial assistance program or the supplemental
2828 nutrition assistance program displays the name and photograph of
2929 the recipient or other authorized person, as appropriate.
3030 SECTION 2. Not later than January 1, 2016, the Health and
3131 Human Services Commission shall ensure that electronic benefits
3232 transfer cards used on or after that date to deliver benefits to
3333 recipients under the financial assistance program under Chapter 31,
3434 Human Resources Code, and the supplemental nutrition assistance
3535 program under Chapter 33, Human Resources Code, conform to Section
3636 531.0911, Government Code, as added by this Act.
3737 SECTION 3. If before implementing any provision of this Act
3838 a state agency determines that a waiver or authorization from a
3939 federal agency is necessary for implementation of that provision,
4040 the agency affected by the provision shall request the waiver or
4141 authorization and may delay implementing that provision until the
4242 waiver or authorization is granted.
4343 SECTION 4. This Act takes effect September 1, 2015.
