| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 13 | 13 | | amended by adding Section 531.0911 to read as follows: |
|---|
| 14 | 14 | | Sec. 531.0911. PHOTOGRAPH ON CERTAIN ELECTRONIC BENEFITS |
|---|
| 15 | 15 | | TRANSFER CARDS. (a) In this section: |
|---|
| 16 | 16 | | (1) "Financial assistance program" means the |
|---|
| 17 | 17 | | financial assistance program established under Chapter 31, Human |
|---|
| 18 | 18 | | Resources Code. |
|---|
| 19 | 19 | | (2) "Recipient" means a person who receives benefits |
|---|
| 20 | 20 | | under the financial assistance program or the supplemental |
|---|
| 21 | 21 | | nutrition assistance program. |
|---|
| 22 | 22 | | (3) "Supplemental nutrition assistance program" has |
|---|
| 23 | 23 | | the meaning assigned by Section 33.0005, Human Resources Code. |
|---|
| 24 | 24 | | (b) The commission shall ensure that each electronic |
|---|
| 25 | 25 | | benefits transfer card used by a recipient, or other person |
|---|
| 26 | 26 | | authorized on the recipient's account, for purposes of receiving |
|---|
| 27 | 27 | | benefits under the financial assistance program or the supplemental |
|---|
| 28 | 28 | | nutrition assistance program displays the name and photograph of |
|---|
| 29 | 29 | | the recipient or other authorized person, as appropriate. |
|---|
| 30 | 30 | | SECTION 2. Not later than January 1, 2016, the Health and |
|---|
| 31 | 31 | | Human Services Commission shall ensure that electronic benefits |
|---|
| 32 | 32 | | transfer cards used on or after that date to deliver benefits to |
|---|
| 33 | 33 | | recipients under the financial assistance program under Chapter 31, |
|---|
| 34 | 34 | | Human Resources Code, and the supplemental nutrition assistance |
|---|
| 35 | 35 | | program under Chapter 33, Human Resources Code, conform to Section |
|---|
| 36 | 36 | | 531.0911, Government Code, as added by this Act. |
|---|
| 37 | 37 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 38 | 38 | | a state agency determines that a waiver or authorization from a |
|---|
| 39 | 39 | | federal agency is necessary for implementation of that provision, |
|---|
| 40 | 40 | | the agency affected by the provision shall request the waiver or |
|---|
| 41 | 41 | | authorization and may delay implementing that provision until the |
|---|
| 42 | 42 | | waiver or authorization is granted. |
|---|
| 43 | 43 | | SECTION 4. This Act takes effect September 1, 2015. |
