|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 63.006, Election Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a) A voter who, when offering to vote, presents the |
|---|
| 14 | 14 | | documentation required under Section 63.001(b) but whose name is |
|---|
| 15 | 15 | | not on the precinct list of registered voters shall be accepted for |
|---|
| 16 | 16 | | voting if the voter registrar verifies the voter as a registered |
|---|
| 17 | 17 | | voter and the voter [also] presents a voter registration |
|---|
| 18 | 18 | | certificate indicating that the voter is currently registered: |
|---|
| 19 | 19 | | (1) in the precinct in which the voter is offering to |
|---|
| 20 | 20 | | vote; or |
|---|
| 21 | 21 | | (2) in a different precinct in the same county as the |
|---|
| 22 | 22 | | precinct in which the voter is offering to vote and the voter |
|---|
| 23 | 23 | | executes an affidavit stating that the voter: |
|---|
| 24 | 24 | | (A) is a resident of the precinct in which the |
|---|
| 25 | 25 | | voter is offering to vote or is otherwise entitled by law to vote in |
|---|
| 26 | 26 | | that precinct; |
|---|
| 27 | 27 | | (B) was a resident of the precinct in which the |
|---|
| 28 | 28 | | voter is offering to vote at the time the information on the voter's |
|---|
| 29 | 29 | | residence address was last provided to the voter registrar; |
|---|
| 30 | 30 | | (C) did not deliberately provide false |
|---|
| 31 | 31 | | information to secure registration in a precinct in which the voter |
|---|
| 32 | 32 | | does not reside; and |
|---|
| 33 | 33 | | (D) is voting only once in the election. |
|---|
| 34 | 34 | | (c) A voter who is not accepted to vote under this section |
|---|
| 35 | 35 | | shall be accepted for provisional voting if the voter executes an |
|---|
| 36 | 36 | | affidavit in accordance with Section 63.011. |
|---|
| 37 | 37 | | SECTION 2. Section 63.011(a), Election Code, is amended to |
|---|
| 38 | 38 | | read as follows: |
|---|
| 39 | 39 | | (a) A person to whom Section 63.001(g), 63.006(c), or 63.009 |
|---|
| 40 | 40 | | applies may cast a provisional ballot if the person executes an |
|---|
| 41 | 41 | | affidavit stating that the person: |
|---|
| 42 | 42 | | (1) is a registered voter in the precinct in which the |
|---|
| 43 | 43 | | person seeks to vote; and |
|---|
| 44 | 44 | | (2) is eligible to vote in the election. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2015. |
