| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 386.251(c), Health and Safety Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (c) The fund consists of: | |
| 13 | 13 | (1) the amount of money deposited to the credit of the | |
| 14 | 14 | fund under: | |
| 15 | 15 | (A) Section 386.056; | |
| 16 | 16 | (B) Sections 151.0515 and 152.0215, Tax Code; and | |
| 17 | 17 | (C) Sections [501.138,] 502.358[,] and 548.5055, | |
| 18 | 18 | Transportation Code; and | |
| 19 | 19 | (2) grant money recaptured under Section 386.111(d) | |
| 20 | 20 | and Chapter 391. | |
| 21 | 21 | SECTION 2. Section 501.138(b-1), Transportation Code, is | |
| 22 | 22 | amended to read as follows: | |
| 23 | 23 | (b-1) Fees collected under Subsection (b) to be sent to the | |
| 24 | 24 | comptroller shall be deposited to the credit of the Texas Mobility | |
| 25 | 25 | Fund[, except that $5 of each fee imposed under Subsection (a)(1) | |
| 26 | 26 | and deposited on or after September 1, 2008, and before September 1, | |
| 27 | 27 | 2015, shall be deposited to the credit of the Texas emissions | |
| 28 | 28 | reduction plan fund]. | |
| 29 | 29 | SECTION 3. Sections 501.138(b-2) and (b-3), Transportation | |
| 30 | 30 | Code, are repealed. | |
| 31 | 31 | SECTION 4. This Act takes effect September 1, 2015. |
