8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter B, Chapter 562, Occupations Code, is | |
10 | 10 | amended by adding Section 562.058 to read as follows: | |
11 | 11 | Sec. 562.058. PHARMACIST REQUIRED TO HONOR PRESCRIPTION. | |
12 | 12 | (a) Subject to the provisions of Subchapter A relating to drug | |
13 | 13 | selection and substitution and except as provided by Subsection | |
14 | 14 | (b), a pharmacist shall honor a valid prescription drug order | |
15 | 15 | written by a practitioner licensed by the State of Texas, including | |
16 | 16 | a prescription drug order for a controlled substance or dangerous | |
17 | 17 | drug. | |
18 | 18 | (b) The provisions of Subsection (a) shall not alter a | |
19 | 19 | pharmacist's right to conscientiously object to the filling of any | |
20 | 20 | prescription drug order. | |
21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided | |
24 | 24 | by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2015. |
