55 AN ACT
66 relating to the requirement that a pharmacist honor a prescription
77 written by a practitioner.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 562, Occupations Code, is
1010 amended by adding Section 562.058 to read as follows:
1111 Sec. 562.058. PHARMACIST REQUIRED TO HONOR PRESCRIPTION.
1212 (a) Subject to the provisions of Subchapter A relating to drug
1313 selection and substitution and except as provided by Subsection
1414 (b), a pharmacist shall honor a valid prescription drug order
1515 written by a practitioner licensed by the State of Texas, including
1616 a prescription drug order for a controlled substance or dangerous
1717 drug.
1818 (b) The provisions of Subsection (a) shall not alter a
1919 pharmacist's right to conscientiously object to the filling of any
2020 prescription drug order.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided
2424 by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2015.
