| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 623.019, Transportation Code, is amended |
|---|
| 11 | 11 | | by amending Subsection (b) and adding Subsection (i) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (b) Except as provided by Subsections (c), [and] (d), and |
|---|
| 14 | 14 | | (i), an offense under Subsection (a) is a misdemeanor punishable by |
|---|
| 15 | 15 | | a fine of not less than $100 or more than $250. |
|---|
| 16 | 16 | | (i) An offense under Subsection (a) is a misdemeanor |
|---|
| 17 | 17 | | punishable by a fine of not more than $25 if the offense involves a |
|---|
| 18 | 18 | | vehicle loaded primarily with agricultural products in their |
|---|
| 19 | 19 | | natural state. If it is shown on the trial of an offense under |
|---|
| 20 | 20 | | Subsection (a) that the actor has previously been convicted one or |
|---|
| 21 | 21 | | more times of an offense punishable under this subsection, the |
|---|
| 22 | 22 | | offense is punishable by, as applicable: |
|---|
| 23 | 23 | | (1) a fine according to the schedules as provided by |
|---|
| 24 | 24 | | Subsection (c); or |
|---|
| 25 | 25 | | (2) a fine calculated in the manner described by |
|---|
| 26 | 26 | | Subsection (d). |

| 27 | 27 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 28 | 28 | | to an offense committed on or after the effective date of this Act. |
|---|
| 29 | 29 | | An offense committed before the effective date of this Act is |
|---|
| 30 | 30 | | governed by the law in effect on the date the offense was committed, |
|---|
| 31 | 31 | | and the former law is continued in effect for that purpose. For |
|---|
| 32 | 32 | | purposes of this section, an offense was committed before the |
|---|
| 33 | 33 | | effective date of this Act if any element of the offense occurred |
|---|
| 34 | 34 | | before that date. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2015. |
