55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the fines for the operation of overweight vehicles
88 transporting agricultural products.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 623.019, Transportation Code, is amended
1111 by amending Subsection (b) and adding Subsection (i) to read as
1212 follows:
1313 (b) Except as provided by Subsections (c), [and] (d), and
1414 (i), an offense under Subsection (a) is a misdemeanor punishable by
1515 a fine of not less than $100 or more than $250.
1616 (i) An offense under Subsection (a) is a misdemeanor
1717 punishable by a fine of not more than $25 if the offense involves a
1818 vehicle loaded primarily with agricultural products in their
1919 natural state. If it is shown on the trial of an offense under
2020 Subsection (a) that the actor has previously been convicted one or
2121 more times of an offense punishable under this subsection, the
2222 offense is punishable by, as applicable:
2323 (1) a fine according to the schedules as provided by
2424 Subsection (c); or
2525 (2) a fine calculated in the manner described by
2626 Subsection (d).
2727 SECTION 2. The change in law made by this Act applies only
2828 to an offense committed on or after the effective date of this Act.
2929 An offense committed before the effective date of this Act is
3030 governed by the law in effect on the date the offense was committed,
3131 and the former law is continued in effect for that purpose. For
3232 purposes of this section, an offense was committed before the
3333 effective date of this Act if any element of the offense occurred
3434 before that date.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2015.
