115 relating to the procedures for discharging bail in certain criminal
126 proceedings.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Article 32.01, Code of Criminal Procedure, is
159 amended to read as follows:
1610 Art. 32.01. DEFENDANT IN CUSTODY AND NO INDICTMENT
1711 PRESENTED. (a) When a defendant has been detained in custody or
1812 held to bail for the defendant's [his] appearance to answer any
1913 criminal accusation, the prosecution, unless otherwise ordered by
2014 the court, for good cause shown, supported by affidavit, shall be
2115 dismissed and the bail discharged, if indictment or information be
2216 not presented against the [such] defendant on or before the last day
2317 of the next term of the court which is held after the defendant's
2418 [his] commitment or admission to bail or on or before the 180th day
2519 after the date of commitment or admission to bail, whichever date is
2620 later.
2721 (b) A surety may file a motion under Subsection (a) for the
2822 purpose of discharging the defendant's bail only.
2923 SECTION 2. This Act takes effect September 1, 2015.
